Abstract

After its entry into force, the European Succession Regulation gave rise to difficulties in its application, mainly within the areas where the new rules brought different solutions. In this article, we deal with lhe most frequent practical issues within Portuguese case law: determination of habitual residence by non judicial authorities, who do not have the same tools of courts in evidentiary discussions; the interpretation of the Regulations' rule on renvoi, when lex domicile referes to the law of a Member State ; and the possibility of use of the escape clause in ascertaining the applicable law to the succession of the tradition Portuguese migrant.
