Direito à habitação

Abstract

Com esta dissertação pretendo, tal como o seu título indica, abordar algumas questões acerca do direito à habitação. Refiro algumas questões porque este trabalho não pretende ser uma análise exaustiva do tema, devido à amplitude do mesmo e à limitação de caracteres a que estou sujeito.Escolhi este tema porque julgo que este direito – à habitação, é dos mais importantes e “fundamentais” – nenhum outro pode ser realizado sem este. Este é um direito em que os cidadãos têm uma expectativa em vê-lo realizado plenamente, mas, na prática tal não acontece.É certo que vivemos em tempos de crise financeira, económica e social – mas não se pode, por tal – por racionalidade económica, descurar os direitos sociais e culturais. Como tratarei adiante, não tratarei apenas do direito “em si” a uma habitação, mas a um efectivo direito, com um conteúdo amplo, que não belisque a dignidade inerente a todo o ser humano. Como refere o Doutor Faria Costa “o que está verdadeiramente em causa é, por sobre tudo, a ideia de que o respeito pela dignidade da pessoa humana impõe que todos os cidadãos possam usufruir de um lugar a que pertençam, de um espaço físico que possam constituir como lar, e aí viver com segurança, com privacidade e sem riscos para a sua saúde física e psíquica”. Irei introdutoriamente abordar o direito à habitação: a sua génese e a sua consagração na nossa Constituição e em outras fontes internacionais.Resumidamente, a consagração deste direito no nosso ordenamento jurídico. Em Portugal – breve “história” do direito à habitação pré 25 de Abril e algumas medidas tomadas pelos poderes públicos – para realmente lhe darem vida, tirando-o do papel. Trataremos dos meios de controlo judicial e também do papel do Provedor de Justiça.

With this dissertation I intend, as its title indicates, to address some questions about the right to housing. I mention some questions because this work does not intend to be an exhaustive analysis of the theme due to its amplitude and the limitation of characters to which I am subject.I chose this theme because I believe that this right - to housing, is one of the most important and "fundamental" - no other right can be realized without it. This is a right in which citizens have an expectation of seeing it fully realized, but, in practice, this does not happen.It is true that we are living in times of financial, economic and social crisis - but one cannot, therefore - out of economic rationality, neglect social and cultural rights. As I will deal with below, I will not deal only with the right "in itself" to housing but with an effective right, with a broad content, which does not undermine the inherent dignity of every human being. As Doctor Faria Costa states "what is really at stake is, above all, the idea that the respect for the dignity of the human being imposes that all citizens may enjoy a place to which they belong, a physical space that they may constitute as home and live there safely, with privacy and without risks to their physical and mental health". I will introduce the right to housing: its genesis and its consecration in our Constitution and in other international sources.In short, the consecration of this right in our legal system.In Portugal - brief "history" of the right to housing before the 25th of April and some policies adopted by the legislator - to really give it life, getting it off the paper. Judicial control and the role of the "Justice Provider".
