Abstract: O Direito Administrativo das Subvenções – Enquadramento, conceito e regime jurídico das subvenções-fomento é um trabalho académico que situa o estudo das subvenções, enquanto instituto de Direito Administrativo, na actividade administrativa de fomento e que, a partir da definição de um conceito restrito de subvenção, percorreu as diversas facetas do seu regime jurídico. No essencial, este estudo assumiu dois objectivos. Por um lado, o objectivo de perceber qual o enquadramento jurídico, quer do ponto de vista constitucional, quer do ponto de vista administrativo, da actividade de fomento e qual o papel das subvenções nesse contexto. Este propósito, cujo desenvolvimento passou pela análise das pertinentes disposições da Constituição da República Portuguesa e pelo estudo da a(A)dministração enquanto actividade administrativa e enquanto organização administrativa, corresponde à primeira parte do trabalho. Neste âmbito, concluiu-se que o fomento é uma tarefa pública constitucionalmente legitimada e, por conseguinte, uma vertente da acção administrativa (em concreto, de incentivo das actividades dos particulares com reflexos no interesse público) levada a cabo por um vasto conjunto de órgãos e entidades da Administração Pública e no seio da qual as subvenções em sentido restrito constituem um meio de fomento, a par de outros como os incentivos fiscais ou o reconhecimento do estatuto de pessoa colectiva de utilidade pública. Por outro lado, motivou-nos o objectivo de descortinar os motivos associados ao elevado número de processos judiciais que versam sobre subvenções, o qual acabou por guiar a segunda parte da dissertação. Após um estudo minucioso da jurisprudência e de múltiplos diplomas legislativos e regulamentares, constatou-se que são muitas as dúvidas e incertezas à cerca das subvenções, desde a sua natureza jurídica, ao regime da invalidade e do incumprimento e, bem assim, à enorme dificuldade de, na ausência de um diploma geral sobre subvenções, perceber que normas – de Direito da União Europeia, do Código do Procedimento Administrativo, do Código dos Contratos Públicos, de legislação especial e de regulamentos – se aplicam a cada caso concreto. As subvenções-fomento em sentido restrito correspondem à entrega de uma quantia pecuniária, não sujeita a reembolso, a um sujeito privado, para ser destinada à realização de uma determinada actividade, cujo exercício se projecta positivamente no interesse público. As subvenções podem ser atribuídas através da prática de um acto administrativo ou da celebração de um contrato administrativo, institutos que foram individualizados e caracterizados. Concluiu-se, pois, que se trata de institutos de Direito Administrativo que estão na génese de uma específica relação jurídico-administrativa: a relação jurídica subvencional. Seguidamente à delimitação do conceito e à caracterização do acto e do contrato de subvenção, percorreu-se o ciclo de vida das subvenções, isto é, desde o procedimento formativo à sua extinção. Neste percurso, realizou-se uma análise sistemática do procedimento de formação das subvenções, das causas e do regime da invalidade, do conteúdo da relação jurídica subvencional e, por conseguinte, dos direitos e obrigações das partes (entidade pública subvencionante e sujeito beneficiário da subvenção) e das consequências do incumprimento de tais obrigações. Tivemos também presente que as subvenções são um veículo de distribuição dos dinheiros públicos. Por este motivo, o procedimento subvencional deverá obedecer aos princípios da concorrência, da igualdade, da transparência e da publicidade em ordem à boa gestão dos dinheiros públicos. O trabalho realizado confrontou, a cada passo, os regimes do acto e do contrato de subvenção, questionando a pertinência do recurso a uma forma de acção em detrimento da outra. Acresce que, ao longo da dissertação, se evidenciou e reiterou a conclusão de que, no ordenamento jurídico português, é necessário pensar as subvenções em sentido restrito enquanto instituto jurídico autónomo e, bem assim, confiar-lhes um regime jurídico próprio que permita colmatar as lacunas e dar resposta às dúvidas e dificuldades que resultam do regime actualmente vigente. Em suma, a presente dissertação assenta na tese da autonomia científica do Direito Administrativo das Subvenções, considerando as particularidades dos seus institutos – nomeadamente, do acto de subvenção, do contrato de subvenção, da ordem de restituição e da revogação e resolução sancionatórias -, mas também da existência de fontes normativas próprias e de princípios jurídicos específicos. ABSTRACT The Grants Administrative Law - Framework, concept and legal regime of promotional grants is an academic work that places the study of grants as an institute of Administrative Law in the state promotion action and that, from the definition of a restricted concept of grant, goes through the different facets of its legal regime. This study has two objectives. On one hand, it aims to understand the legal framework of the state promotion action both from a constitutional point of view and an administrative point of view, and the role of grants in this context. This purpose, whose development included the analysis of the relevant provisions of the Constitution of the Portuguese Republic and the study of administration as an activity and as an organization, corresponds to the first part of the work. In this context, it was concluded that the state promotion action is a constitutionally legitimate public task and, therefore, a part of the administrative action. It is carried out by a vast set of organs and entities of the Public Administration and within which grants, alongside, for example, tax benefits or recognition of the public utility status, are a means of promotion. On the other hand, there is the goal of uncovering the reasons associated with the high number of court cases that deal with grants guided the second part of the dissertation. After a thorough study of jurisprudence and regulation, it was found that there are many doubts and uncertainties surrounding grants regarding their legal nature and the invalidity and non-compliance regime. It is also extremely difficult to determine which specific rules – of European Union law, the Administrative Procedure Code, the Public Procurement Code and special legislation and regulations - apply to each specific case in the absence of a grants general law. Grants correspond to the delivery of a non-refundable amount of money to a private beneficiary to carry out a specific activity, whose exercise positively projects in the public interest. Grants can be awarded through an administrative act or an administrative contract. It was concluded, therefore, that these institutes, who have been individualized and characterized, belong to administrative law and are at the origin of a specific administrative relationship: the grant relationship. Following the definition of the concept and the characterization of the act and the grant contract, the life cycle of the grants was covered, from the formative procedure to their extinction. Along this path, a systematic analysis was carried out of the grants procedure, the causes and the invalidity regime, the grant relationship content and, therefore, the rights and obligations of the parties (Public Administration and beneficiary) and the consequences of non-compliance. We were also aware that grants are a vehicle for distributing public money. For this reason, the grant procedure should comply with the principles of competition, equality, transparency and publicity in order to the good management of public money. The work carried out confronted at each step the rules of the act and the grant contract, questioning the relevance of using one form of action to the detriment of the other. Furthermore, this dissertation concludes that the Portuguese legal system requires not only the consideration of grants as an autonomous legal institute but also the development of a legal framework that allows filling the existing gaps and answering the doubts and difficulties that result from the current regime. Finally, this dissertation postulates the thesis of scientific autonomy of Grants Administrative Law, considering the singularities of its institutes - namely, the grant act, the grant contract, the restitution order and the sanctioning revocation and resolution -, but also the existence of its own normative sources and specific legal principles.
