Abstract: O texto busca refletir o fenômeno do direito brasileiro, no sentido de sua crise atual, a partir do aprofundamento crítico da construção do direito moderno, pelos questionamentos decorrentes das problemáticas da escravidão e do racismo para o sentido do Direito. Procura considerar em profundidade o jurisprudencialismo no Brasil, desde a consideração da historicidade e do sentido do Direito pela metodologia crítico-reflexiva. Assim, em primeiro lugar, aborda-se a temática da escravidão para o pensamento jurídico através da problematização das intencionalidades envolvidas, o campo de pesquisa, as dinâmicas, os problemas metodológicos e o sincronismo, com o objetivo de superação da mitologia jurídica criada em conjunto com o direito brasileiro, desde a era da escravização legítima de seres humanos. Aprofundam-se os desdobramentos da modernidade jurídica diante da temática da escravidão, para posicionar o trabalho dentro dos quadros mentais da construção do direito moderno ocidental. Após, diante dos limites impostos pela autonomia do Direito e pela separação das problemáticas propriamente históricas e jurídicas, foi feita a pesquisa do direito e da escravidão no Brasil para reconhecimento crítico da dimensão do campo de pesquisa oferecido ao pensamento jurídico e à cultura jurídica brasileira pela temática da escravidão. Realiza-se o esforço de contextualizá-la dentro das aberturas para reflexão da realização do direito em razão da especificação da crise do direito. Foi considerada, assim, a escravidão como contraponto crítico mais profundo ao projeto moderno do direito que, não sendo um fenômeno irresistível, foi sendo construído contextualmente, muito antes da uniformização e universalização desenvolvidas no contexto de construção dos direitos humanos no séc. XX. Nesse sentido, evidenciam-se os problemas decorrentes do aproveitamento da historicidade construída pelo direito positivista para se pensar a superação da crise do direito pelo caminho do jurisprudencialismo no Brasil. Em seu centro, como indicado no texto, encontra-se a difícil questão da aproximação da dogmática do Direito, enquanto caminho e racionalidade para a realização prática de direitos, do sentido decorrente da historicidade para o pensamento jurídico crítico. Após a indicação das especificidades do fenômeno jurídico no país, bem como de sua crise atual, em razão de sua formação no tempo, passa-se a problematizar o paradigma jurídico em face da historicidade, em aposta consciente de que o jurisprudencialismo seria a melhor opção para reconhecer o sentido do Direito no Brasil. Trata-se o trabalho, em especial, de uma reflexão crítica sobre os quadros mentais de uma pretensa formação mitológica da juridicidade fundadora da individualidade jurídica, com respeito à sincronia, bem como sobre as ideias filosóficas reconhecidas na juridicidade atual. Assim, defende-se que pouco pode ser alcançado pelo pensamento jurídico brasileiro se desconsideradas as problemáticas decorrentes do direito da escravidão e do racismo para a compreensão da crise do direito no país. Tal preocupação apresenta-se como o principal eixo de reflexão para a superação da crise do direito pelo jurisprudencialismo, visto como a melhor opção para superá-la no Brasil, devendo-se refletir profundamente para que se faça a construção de uma Teoria Crítico-Reflexiva do Direito no país, de forma a realizarem-se profundas mudanças no campo do direito e do pensamento jurídico brasileiros, especialmente a mudança do ensino do direito, que deve ser pensado a partir da valorização da interpretação jurídica para a construção de um projeto de Direito.
The goal of this research is to consider the Brazilian law phenomenon and its current crisis, promoting a deeper critical perspective regarding the formation of modern law and the questions that arisen from the matters of slavery and racism for the meaning of Law. Its objective is to profoundly considerate the notion of jurisprudentialism in Brazil, from the ideas of historicity and the meaning of Law present in the critical methodology. Thus, in first place, it will approach the matter of slavery for legal thinking by questioning the intentions involved, the research area, the dynamics, the methodological problems and the synchronism, with the objective to overcome the legal mythology created in parallel with Brazilian law, since the era of legal slavery of human beings. We intend to deepen the understanding of the deployment of modern law regarding the matter of slavery, so that this research is a part of the mental frame of the construction of the modern law in the Occident. Later, taking into account the limits imposed by the autonomy of Law and by the distance between historical and legal matters, we studied Law and slavery in Brazil with the intention of forming a critical understanding of the dimensions of the research area available to Brazilian legal thinking and legal culture regarding slavery. Thus, there is the effort to contextualize slavery within the possibilities of thought regarding the accomplishment of Law as a result of the specification of Law crisis. Slavery was considered as a critical and deeper counterpoint to the modern project of Law, which cannot be seen as irresistible, but was constructed in context, much earlier than the uniformization and universalization presented by human rights in the 20th century. In this sense, the problems resulted by the usage of the historicity constructed by the positive Law to think the possibility of overcoming Law crisis in Brazil through the jurisprudentialism are in evidence. In its center, as indicated by the text, there is the challenging matter of approaching the Law dogmatic as a way for the rationality of the practical accomplishment of rights, regarding historicity for critical legal thinking. After indicating the specifics of legal phenomenon in Brazil and its current crisis, as a result of its formation during time, we can get to the problematization of legal paradigm in face of historicity, betting consciously that jurisprudentialism would be the best option for recognizing the sense of Law in Brazil. This work is mainly a critical thinking about the mental frames of a supposed mythological legal formation which is founding for legal individuality, regarding synchronism, as well as for philosophical ideas found in current Law. Thus, it sustains that little can be achieved through Brazilian legal thinking if it does not consider the matters arisen from slavery and racism Law for the understanding of the current legal crisis in Brazil. This concern presents itself as the main thing to think to overcome the Law crisis by jurisprudentialism, seen as the best option to do it in Brazil, demanding that there is a deepen thought for molding the Critical Legal Thinking Theory in the country, so that deep changes can be made in Brazilian Law and legal thinking, especially in legal teaching, which must be considered from the value of legal interpretation for creating a project for Law.
