The construction of the European single (internal) market in the field of insurance did not strictly comply with the 1992 deadline. This paper analyses the steps that have been taken in that process, in special the “detour” that the second generation of insurance directives has meant in terms of a “two speed” single market, due to inexistence of required harmonization of consumer protection at community level as pointed out by the EC Court of Justice in previous case-law. Nonetheless, the third generation of insurance directives has been adopted providing the free provision of insurance services for all types of insurance and irrespective of their passive or active provision in the internal market. A post scriptum is added to the paper, originally written in the course of European Insurance Law at Catholic University of Leuven as Erasmus student, describing the implementation of the “insurance single license” in Portuguese Law. | URI: | https://hdl.handle.net/10316/28794 | Rights: | openAccess |
