Resumo: O presente estudo objetiva oferecer uma reflexão originária do mundo medieval capaz de demonstrar a singular significância, importância e conceituação da virtude da Justiça a partir do pensamento jurídico-filosófico de Santo Tomás de Aquino. Volta-se o estudo para uma época ímpar da história da humanidade, capitaneada pelo pensamento cristão, mas, também, envolta em um espaço e tempo de grandes transformações geradas pelo saber acadêmicoformal e pelo desenvolvimento das ciências, particularmente das ciências humanas. Nessa dimensão, eclode o surgimento e apogeu das universidades, onde a escolástica tomista triunfa soberana, inaugurando e fincando os fundamentos da universalização do conhecimento. Junto a isso, categorias jurídico-filosóficas como a lei e o Direito auferem nova dinâmica, designadamente por conduto do novel sistema jurídico-religioso tomista, dotando a virtude da Justiça de instrumentais que a elevam a categoria central promotora da legitimidade e estabilidade das relações humanas. A Justiça em Tomás de Aquino salta, destarte, de um domínio puramente abstrato para avançar como padrão ético-moral de sensível e palpável aplicação no mundo empírico dos homens, sempre sob orientação e ordenação filosófica e jurídico-cristã. Embora complexa, a ideia de Justiça em Tomás de Aquino é coesa, sistemática, científica e, diante disso, utilizável para o bem e a felicidade dos homens, conferindo o devido e necessário norte para alcance da pacificação social. A divisão didática da Justiça segundo Tomás deriva do cuidado do preclaro medieval em conferir-lhe uma configuração de aplicação concreta no ambiente da razão, munindo-a de densidade éticojurídica sugestiva de sua assimilação pelos homens no mundo real que o circunda. É dizer que a Justiça geral e a especial refletem um dualismo peculiar de legitimação para as variações das relações humanas, públicas e particulares, com potencial para socorrer os protagonistas dos mais elevados e dos mais simplórios pactos, numa dosagem de igualdade que nem sempre expurga os extremos. Por fim, entendemos admissível uma reflexão conceitual e jurídicocristã da Justiça tomista como elemento de inserção interpretativa que pode auxiliar na compreensão e aplicação do Direito do nosso tempo, especialmente pelo mérito de conferir a ele, o Direito, a condição de objeto da Justiça, e, com isso, consumando-o como categoria indissociável do ideal de dar a cada um o que é seu.
This study seeks to offer an originating reflection about the medieval world able to demonstrate the particular significance, importance and concept of the virtue of Justice from the legal-philosophical thought of St. Thomas Aquinas. It turns to the study of a unique era in human history, led by Christian thought, but also wrapped in a space and time of huge transformations generated by the formal-academic knowledge and the development of science, particularly the humanities. In this dimension, the rise and heyday of the universities hatch, where the Thomist scholasticism triumphs sovereign, opening and digging the foundations of universal knowledge. Besides this, the legal-philosophical categories such as law and Law Studies receive new impetus, particularly because of the new legal and religious Thomist system, giving the virtue of Justice the instruments which elevate it to the central category promoter of legitimacy and stability of human relationships. Justice in Aquinas jumps, thus, from a purely abstract field to an advance one as an ethical and moral standard of sensitive and tangible application in the empirical world of men, always under the philosophical and legal-Christian guidance and ordering. Although the idea of Justice in Thomas Aquinas is complex, it is cohesive, systematic, scientific and, before that, usable for the welfare and happiness of men, giving necessary and due north to reach the social pacification. The didactic division of Justice according to Thomas Aquinas comes from the illustrious medieval care to give it a setting of concrete application on the environment of reason, arming it of legal and ethical density suggestive of its assimilation by men in the real world that surrounds them. It is said that the general and particular justice reflect a peculiar dualism of legitimation for the variations of human, public and private relationships, with a potential to help the protagonists of the highest and the most simplistic pacts, with a dose of equality which does not always purge the extremes. Finally, we consider that it is acceptable a conceptual and legal-Christian reflection of Thomist Justice as an element of interpretative insertion that can assist in understanding and applying the Law of our time, especially in the merit of giving it, the Law, the condition of object of Justice and, with it, consuming it as inseparable category from the ideal category to give each person what is his/her own.
