A CRIANÇA E A MANUTENÇÃO DAS SUAS RELAÇÕES AFETIVAS COM TERCEIROS DE REFERÊNCIA O DIREITO AO CONVÍVIO

Abstract

A família tem um papel vital no desenvolvimento pleno e harmonioso da criança desde o seu nascimento. Porém, a família é uma figura em constante alteração, sendo o surgimento do afeto uma das maiores mudanças observadas, devido a tal a família deixou de ser encarada como uma fonte de riqueza para passar a centro de afetos e segurança.Esta alteração levou ao surgimento de variadas formas de organização familiar que permitem o contacto da criança não só com os pais e irmãos, mas também com vários outros sujeitos, familiares ou não, que ganham um destaque na sua vida, criando-se assim importantes relações afetivas que permitem o desenvolvimento pleno e harmonioso da criança.O desenvolvimento pleno e harmoniosa da criança está dependente destes laços afetivos que a criança estabelece ao longo da sua vida, sendo tal reconhecido em diversos diplomas.Torna-se, assim, importante perceber que tutela legal confere o legislador a estas relações afetivas e como é efetivado e protegido o direito da criança ao convívio com estes terceiros com quem criou uma relação afetiva significativa.Atualmente, o nosso ordenamento jurídico apenas prevê, no seu artigo 1887.º-A do Código Civil, o direito ao convívio da criança com os ascendentes e irmãos, não se estendendo à grande família da criança ou a outros terceiros. Mostra-se, assim, necessário proceder a uma alteração deste preceito legal, de forma a estar expressamente contemplado o direito da criança ao convívio com terceiros com quem criou uma relação afetiva significativa.

The family plays a vital role in the full and harmonious development of the child from the birth. However the family is a constantly changing figure, being the emergence of the affection one of the biggest changes, as a result the family is no longer seen as a source of wealth and becomes a center of affection and security. This change led to the emergence of various forms of family organization that allow the child to come into contact not only with parents and siblings, but also with various other subjects, family or not, who gain a prominence in their life, creating importante affective relationships that allow the child’s full and harmonious development.The full and harmonious development of the child depends on these affective bonds that the child establishes throughout his or her life, which is recognized in several diplomas. It is, therefore, importante to realize what legal protection confers the legislator to these affective relationships and how it is protected the child’s right to contact these third parties with whom they have created a significant affective relationship.Currently, the portuguese legal system only provides, in article 1887º-A of the Civil Code, for the child’s right to contact with ascendants and siblings, not extending to the child’s large family or other third parties.It is therefore necessary to change this legal precept to explicitly contemplate the child’s right to contact with third parties with whom they have created a significant affective relationship.
