A AUTORIZAÇÃO DE UTILIZAÇÃO NAS RESIDÊNCIAS UNIVERSITÁRIAS PRIVADAS: ESPECIFICIDADES LEGAIS EM 2 MUNICÍPIOS PORTUGUESES

Abstract

This dissertation aims to describe and bring new contributions to a more detailed understanding of a topic that has been assuming increasing relevance in our country: the legal framework (or lack thereof) of the figure of private university residences. Despite being a topic that has been little discussed so far, it is of great importance, not only due to the increasing number of new figures and types of accommodation for university students, - which have taken their place in Portugal in recent years - but also by the need to have a universal and complete legal regime, as happened with identical figures, such as local accommodation.After dealing with the legally applicable themes, we will finally talk about what is intended to be the main focus of this dissertation: private university residences. This block not only explains the importance of the legal treatment of this new figure, but also seeks to compare it with other types of accommodation for students that, as already mentioned, have been increasing exponentially in recent years. It is also necessary for us to take stock of the potential impact that the use of each of the applicable uses would have in this case. Consequently, and before making some final considerations on the subject, two specific cases of private university residences, located in Porto and Coimbra, whose authorization for use provided for different uses will be presented. Based on the analysis and study of these two models, and on everything that is expressed throughout this dissertation, it is expected that it can contribute to objectifying some of the questions initially formulated.

A presente dissertação tem como objetivo descrever e trazer novos contributos para uma compreensão mais circunstanciada de um tema que tem vindo a assumir crescente relevância no nosso país: o enquadramento legal (ou a falta dele) da figura das residências universitárias privadas. Apesar de ser um tema até agora pouco tratado, reveste-se de elevada importância, não só pelo aumento crescente de novas figuras e tipologias de alojamento para estudantes universitários, – que têm tomado o seu lugar em território nacional, nos últimos anos – mas também pela necessidade de ter um regime legal universal e completo, tal como aconteceu com figuras idênticas, como é o caso do alojamento local. Após tratar os temas legalmente aplicáveis, falaremos por fim, daquele que se pretende que constitua o foco principal desta dissertação: as residências universitárias privadas. Neste bloco, não só se explica a importância que o tratamento legal desta nova figura apresenta, como se procura confrontar com outras tipologias de alojamento para estudantes que, como já foi referido, têm vindo a aumentar exponencialmente nos últimos anos. Cumpre-nos, ainda, fazer um balanço do potencial impacto que teria neste caso, a utilização de cada um dos usos aplicáveis. Consequentemente, e antes de serem tecidas algumas considerações finais sobre o assunto, serão apresentados dois casos concretos de residências universitárias privadas, situadas no Porto e em Coimbra, cuja autorização de utilização previu diferentes usos. Com base na análise e estudo destes dois modelos, e em tudo o que fica expresso ao longo desta dissertação, espera-se que ela possa contribuir para objetivar algumas das questões inicialmente formuladas.
