Abstract: Com a presente dissertação de mestrado pretende-se discorrer sobre o tema da prostituição.Será inicialmente feita uma exposição sobre a história e evolução da prostituição ao longo dos tempos, e concretamente em Portugal. Serão depois dispensados alguns pensamentos à prostituição em si.Num segundo momento, após considerações sobre conceito de material, bem jurídico, dignidade penal e o direito penal enquanto direito de ultima ratio, será analisado o crime de lenocínio simples, previsto no artigo 169º. nº1 do Código Penal. Nesse sentido será tida em conta a doutrina dominante que afirma a inexistência de um bem jurídico tutelado na norma incriminadora, bem como a defesa de que tal norma é inconstitucional, sendo então tidos em conta os sucessivos Acórdãos do Tribunal Constitucional sobre o tema.Em seguida serão descritos modelos que representam opções legislativas sobre a prostituição em vigor noutros países.Posteriormente, numa quarta parte, colocar-se-á a questão de saber qual a relação entre a prostituição e o tráfico de pessoas para fins de exploração sexual, nomeadamente se a legalização propicia o aumento do tráfico ou situações de exploração.Por fim, estes fatores serão utilizados com o objetivo de traçar um possível modelo para Portugal, onde se retire a prostituição da clandestinidade e estigmatização que se encontra, o lenocínio seja descriminalizado e os trabalhadores do sexo ouvidos de forma a poderem exercer a sua profissão com segurança e iguais em direitos e deveres a qualquer outro trabalhador. Isto, sem nunca perder de vista o combate daqueles comportamentos que devem ser alvo de incriminação, o tráfico e a exploração sexual.
With the present master's thesis, it is intended to discuss the subject of prostitution.It will primarly focus on introducing the history and evolution of prostitution over time, specifically in Portugal. Aditionally, thoughts regarding prostitution itself, will also be taken into account. Secondly, after focusing on the concept of material, legal property, criminal dignity and criminal law as a right of ultima ratio, pimping crimes, present in article 169 nº 1 of the Criminal Code, will be analyzed. In this sense, the prevailing opinion denotes a lack of legal assets protected by the indictment, as well as the defense of its inconstitutionality and the successive Constitutional Court judgments on the subject will be taken into account.Next, models representing regulatory options on prostitution, in other countries, will be described.Later, in a fourth part, the question will be raised regarding the relationship between prostitution and human trafficking for sexual exploitation, more precisely whether legalization leads to an increase in trafficking or to situations of exploitation.Finally, this variables will be used with the aim of defining a possible model for Portugal, where prostitution is no longer seen as clandestine and stimatized, where pimping is decriminalized and sex workers are noticed and able to exercise their profession with safety and equal rights and duties to any other worker. This, without ever losing sight of the struggle against those behaviours that should be targeted of incrimination, trafficking and sexual exploitation.
