Abstract: Este escrito baseia-se numa análise criteriosa sobre a questão do bem jurídico-penal tutelado no crime de Tráfico de Órgãos Humanos.A problemática do Tráfico de Órgãos Humanos trata-se de um fenómeno em ascensão à escala global, apesar de, à data, contar com pouca expressão em Portugal. Precisamente por se tratar de um fenómeno emergente e a grande escala torna-se absolutamente necessária à sua regulamentação através de instrumentos internacionais nos quais cada país na sua singularidade faz adaptar a sua legislação. Este estudo preocupa-se em especial com o problema do Tráfico de Órgãos Humanos no universo da lei nacional portuguesa sendo também feito um percurso analítico pela vertente internacional da problemática. Este escrito foca-se na vertente predominantemente jurídica do tema e almeja à luz do direito estudar, em especial, a incriminação autónoma do Tráfico de Órgãos Humanos e em geral o tipo incriminador do Tráfico de Pessoas. É importante referir que se trata tanto num caso como noutro de práticas ilegais que podem ter consequências fatais na vida das pessoas e que ainda existe um longo caminho a percorrer para combater e prevenir tais práticas. Nesta análise jurídica procura-se igualmente esclarecer alguns pontos como a questão do bem jurídico tutelado pela norma incriminadora do art.º 144-B do Código Penal (CP), abordando dúvidas quanto à eficácia do consentimento, clarear o conceito indeterminado da especial vulnerabilidade da vítima e a evolução do fenómeno do TOH em algumas legislações estrangeiras pioneiras nesta temática.Dificilmente se chegará a uma erradicação total e efetiva deste fenómeno uma vez que a maior parte dos casos ocorrem no mundo da clandestinidade onde a justiça muito raramente consegue penetrar. Por mais incriminações penais que existam, os potenciais e altamente lucrativos produtos financeiros deste tipo de ilícito irão sempre aliciar as redes criminosas para tais práticas e desafiar as leis dos países em que estas operem.
This study is based on a careful analysis of the issue of legal and criminal protected good in the crime of Human Organ Trafficking (THO).The problematic of THO is a global-rising phenomenon on a daily scale though, to date, has little expression in Portuguese’s society and law. Precisely because it’s an emerging phenomenon turns out to be absolutely necessary to regulate it through the new European international instruments in specific, in which each country -with each singularity and characteristics – will be able to adapt to its own legislation. This study is particularly concerned with the problem of THO in the universe of Portuguese national law implementation, in which an analytical approach is also taken into account with international influences.This writing focuses on the predominant legal aspect of the above topic and aims in the light of the law to study, in particular, the autonomous incrimination of THO and the incriminating type of Trafficking in Human Beings (or Human Trafficking). It is important to mention that these are both illegal practices that can have fatal consequences on people's lives and there is still a long way to go in order to combat and prevent such practices. This legal analysis also seeks to clarify points such as the question of the legal protected good by the incriminating norm of article 144-B of the Portuguese Penal Code (CP), address doubts about the effectiveness of consent, clarify the indeterminate concept of the special vulnerability of victim and the evolution of the HOT phenomenon in some pioneering foreign legislation related to this topic.It will be difficult to achieve a total and effective eradication of this phenomenon since most of the cases occur in the undeclared world where justice very rarely manages to penetrate. No matter how criminal offenses exist, the highly profitable financial products of this type of offense will always entice criminal networks into such practices and will always be a challenge to the laws of the countries where they are able to operate.
