Resumo: O crime de Infanticídio vem previsto no artigo 136º do Código Penal Português e segundo este “a mãe que matar o filho durante ou logo após o parto e estando ainda sob a sua influência perturbadora é punida com pena de prisão de um a cinco anos.” A prática deste ilícito levanta diversos problemas e questões. Falamos de problemas não só do foro criminal, mas também de situações que extravasam o campo jurídico, sendo possível envolver aqui conhecimentos do mundo da psicologia e da medicina. Assim, e numa perspetiva de tentar compreender o comportamento e conduta do agressor, é necessário relacionarem-se os diferentes elementos do ilícito, isto é, desde a vontade que impele o agressor a cometer o ato até à forma como o próprio agressor é influenciado ou perturbado para tal, pois só deste modo será possível determinar o que o leva a perpetrar o crime. É de realçar ainda que a natureza privilegiada do crime de Infanticídio advém dessa mesma “influência pós-parto”, o que poderá traduzir-se numa diminuição da culpa do agressor. Porém, é importante haver provas factuais que façam a conexão entre essas perturbações e o momento do próprio parto. The crime of Infanticide comes under Article 136 of the Portuguese Penal Code and according to this “a mother who kills her child during or shortly after delivery and is still under its disturbing influence is punished with a prison sentence of one to five years.” The practice of this offense raises several problems and questions. We speak of problems not only in the criminal field but also in situations that go beyond the legal field, being possible to involve here knowledge of the world of psychology and medicine. Therefore, in a perspective of trying to understand the behavior and conduct of the aggressor, it is necessary to relate the different elements of the offense, that is, from the will that impels the aggressor to commit the act to the way in which the aggressor is influenced or disturbed to do so because only then will it be possible to determine what leads him to perpetrate the crime. It should also be noted that the privileged nature of the crime of Infanticide stems from the same “postpartum influence”, which may translate into a decrease in the aggressor's guilt. However, it is important to have factual evidence that makes the connection between these disorders and the moment of delivery.
