Title: Responsabilidade Civil do Fornecedor Face à Lei Angolana de Defesa do Consumidor - Confronto com o Direito Português

Abstract: Abstract This study seeks to adress the topic of “Supplier Civil Liability face of Angolan Consumer Protection Law - Confrontation with Portuguese Law”, by the introduction in this law of a new legal framework built upon a strict liability of the supplier granting more protection to the consumer. This consists in a change of the subjectivism and of the individualism of the traditional responsability to the strict liability of the supplier allowing that who provides, responds by the vices and defects of their products and services, regardless of fault. We analise the srict liablity of the supplier which stems from the products or services defect placed in the market by this same supplier in two aspects: the liability for the product itself and the liability for the vices of the good or service. Thus, for that the supllier to be obligated to meet the vices and defects of their services and products, the aggrieved must prove the damage, the defect and the link of causality between the damage and the defect. We have centered our work in the analization of the act of consumption as legal relationship connceting the end consumer to a supplier of goods and services being that the legal nature is in reality a legal business and we proceed with the conceptualization of the elements of that special consumer relation: consumer and supplier as subjects; goods and services as object. In general, the consumer subjects himself to sign adhesion contracts, wihtout any oportunity of discussion about its conditions, being abusive or ambiguous wherefore throughout the study we presente the solutions that the Law no. 4/03 of Febraury 18 – Law about General Clauses of the Contracts – establishes about this subject. Strictly speaking, we consider that a product or survice is defective when it doesn´t provide the security that is legitimately expected. However, either the product security neither the liablity of the supplier are absolut being that the law accepts the risks to health and to the security of the consumers that are normal and predictable and admits certains causes that exclude the suppliers´ liability. The comparissons made in the presente study between the decisions of the Portuguese Supreme Court of Justice and the doctrine within the present approach on the General Clauses of the Contracts inserted in the consume contracts certify the agreement between the doctrine and the portuguese jurisprudence and also sets as an objective the permission to verify in which way the future angolan doctrine, and its jurisprudence, may develop themselves to better serve the consumers interests. The angolan consumerism is marked by the emergence of a variety of institutions since the declaration of independence which allows us to verify the distinction between the previous institutional and law environment of consumer defence that was in force with the prior Consitutional Laws and the actual scene of protection of the consumer interests established with the entering in force of Law no. 15/13 of July 22. The grounds of the presents theme approach lies in the certification through the Angolan Consumer Protectoin Law, of a further commitment of the rule of law and democracy with the consumer tutelage denoting the insertion of Angola in the context of the Nations, whose concern with the defence of the consumer rights is supported by due respect for the dignity of the human person.
Resumo Este estudo procura abordar o tema “Responsabilidade Civil do Fornecedor Face à Lei Angolana de Defesa do Consumidor - Confronto com o Direito Português”, por este diploma legal introduzir um novo regime jurídico assente na responsabilidade objectiva do fornecedor, garantindo uma melhor protecção ao consumidor. Nisto consiste a mudança do subjectivismo e do individualismo da responsabilidade tradicional para o objectivismo da responsabilidade do fornecedor, permitindo que quem fornece bens e serviços com defeito, responde pelos defeitos e vícios dos seus produtos e serviços, independentemente de culpa. Analisamos a responsabilidade objectiva do fornecedor, que decorre do defeito do produto ou do serviço por este colocado no mercado de consumo, nas suas duas vertentes: a Responsabilidade pelo facto do produto e a Responsabilidade por vício do bem e do serviço. Portanto, para que o fornecedor responda pelos defeitos e vícios de seus produtos e serviços, o lesado deve provar o dano, o defeito e o nexo de causalidade entre o dano e o defeito. Centramos, assim, o nosso estudo na análise do acto de consumo, enquanto relação jurídica que liga um consumidor final a um fornecedor de bens e serviços, cuja natureza jurídica é, na verdade, um negócio jurídico, e procedemos à conceitualização dos elementos dessa especial relação de consumo: consumidor e fornecedor, como sujeitos; bens e serviços, como objecto. Regra geral, o consumidor sujeita-se a assinar contratos de adesão, sem oportunidade de discussão das suas cláusulas, sejam abusivos ou ambíguos, pelo que, ao longo do trabalho, apresentamos as soluções que a Lei n.º 4/03, de 18 de Fevereiro – Lei sobre as Cláusulas Gerais dos Contratos – estabelece sobre o controlo dessas cláusulas. Em bom rigor, consideramos que um produto ou serviço é defeituoso quando não oferece a segurança que dele os utentes legitimamente esperam. No entanto, quer a segurança do produto, quer a responsabilidade do fornecedor não são absolutas, uma vez que a lei aceita os riscos à saúde e à segurança dos consumidores que sejam normais e previsíveis e admite determinadas causas que excluem a responsabilidade do fornecedor. A comparação, que fizemos no presente estudo, entre os Acórdãos do Supremo Tribunal de Justiça português e a doutrina, no âmbito da abordagem sobre as cláusulas contratuais gerais inseridas nos contratos de consumo, certifica a concordância entre a doutrina e a jurisprudência portuguesa e tem ainda como objectivo permitir ver de que forma quer a futura doutrina angolana, quer a sua jurisprudência, possam desenvolver-se, para melhor servir os interesses dos consumidores angolanos. O consumerismo angolano está marcado pelo surgimento de um conjunto de instituições desde a proclamação da independência, o que permite verificar a distinção entre o anterior ambiente jurídico-institucional de defesa do consumidor, que vigorou com as anteriores Leis Constitucionais, e o actual cenário de protecção dos interesses dos consumidores, estabelecido com a entrada em vigor da Lei n.º 15/03, de 22 de Julho. O fundamento da abordagem do presente tema radica na certificação, através da Lei angolana de Defesa do Consumidor, de um maior compromisso do Estado de direito e democrático com a tutela do consumidor, denotando a inserção de Angola no contexto das Nações, cuja preocupação com a defesa da vítima ou da parte mais fraca da relação de consumo é respaldada pelo respeito da ordem pública da protecção da dignidade da pessoa humana.
