Abstract: A presente investigação tem por escopo reexaminar as premissas jurídicas, sociológicas, econômicas, políticas, éticas e históricas que se utilizou a humanidade para a construção de um sistema de produção global que não consegue perenizar, e tampouco universalizar, direitos laborais mínimos. O objetivo desse método é reunir elementos de convicção aptos a justificar a criação de um novo paradigma cultural, para motivar a propositura de soluções jurídicas conducentes à efetivação de justiça social, por intermédio da universalização do Direito do Trabalho e da tutela global das relações laborais. De início, serão analisados diversos modelos socioeconômicos desde a antiguidade até aos dias de hoje, nomeadamente as sociedades em bando, tribal, imperial, feudal, capitalista comercial, capitalista industrial e capitalista financeira, bem como as relações laborais subjacentes a cada uma. Dessa forma, será possível identificar o valor social do trabalho em cada um dos modelos e o padrão de justiça distributiva respectivo. O objetivo de tal análise é superar quaisquer espécies de determinismos em relação ao baixo grau de justiça social decorrentes das relações laborais, procurando-se afirmar, ao contrário, que trabalho e justiça podem caminhar lado a lado. Para demonstrar a plausibilidade dessa hipótese, serão analisadas algumas questões referentes aos padrões antropológicos de inerência ou não da justiça como um atributo humano e sua interseção com os fatores cooperação e competição. Também será investigado o papel da economia, das relações de poder e da ética como elementos contributivos para a formação de sociedades mais justas e equitativas. Uma vez verificada a atuação desses fatores como condicionantes de justiça social nas relações laborais, a pesquisa irá intentar demonstrar a necessidade de intervenção do Direito em três aspectos: regulação, fiscalização e tutela jurisdicional. Nesse mister, partir-se-á dos modelos regulatórios desde a antiguidade, designadamente a escravidão, a servidão e as corporações de ofício, até ao assalariamento, com o nascimento do Direito do Trabalho, como ramo da ciência jurídica. Do modelo estatal de regulação das relações laborais, passar-se-á ao estudo dos regramentos internacionais, principalmente das normas advindas da Organização Internacional do Trabalho. Por sua importância e legitimidade mundial, a OIT será objeto de detido estudo, perpassando por sua estrutura funcional, espécies normativas, características de suas normas e enquadramento propedêutico, assim como seu processo legislativo e a integração de suas normas nos ordenamentos jurídicos nacionais. Ao fim, será intentado um sucinto diagnóstico crítico ao seu modelo regulatório, tanto em relação ao processo legislativo, como da efetividade de suas normas. Ainda sob o viés regulatório, serão averiguadas as interrelações dos direitos laborais com os direitos humanos e a hipótese de regulação internacional por meio da inserção de cláusulas laborais em tratados internacionais comerciais. Na seara da fiscalização das relações laborais pela ótica internacional, serão examinados detidamente os controles de supervisão na aplicação de normas da OIT, realizados de forma permanente, por provocação e o de controle especial de liberdade sindical, realizados por seus organismos internos, cada qual em sua esfera de atribuição. A eficácia desse sistema de supervisão será feita em cotejo com a Reforma Trabalhista brasileira de 2017, podendo, assim, aferir-se, em um caso concreto, suas qualidades, deficiências e limites. A possibilidade de tutela dos direitos laborais, no plano global, será empreendida a partir do exame de sua tutela jurisdicional internacional hodierna, desde os tribunais de direitos humanos regionais, o Tribunal Administrativo da OIT, os órgãos de solução de disputa da OMC e a Corte Internacional de Justiça, até à tutela jurisdicional dos Estados. Apreciar-se-á também a tutela dos direitos trabalhistas com suporte em algumas propostas já existentes de criação de um tribunal internacional de Direitos Humanos. Por fim, propor-se-á a criação de um tribunal internacional do trabalho e de uma promotoria internacional do trabalho, como organismos internacionais autônomos, ainda que vinculados à OIT. O primeiro com jurisdição internacional para tutelar os direitos internacionais do trabalho ratificados nos países signatários, com competência consultiva e contenciosa. O segundo para demandar esta tutela junto ao aludido tribunal ou de forma não contenciosa junto aos demandados. Desse modo, restará completo o círculo virtuoso de regulação, fiscalização e tutela das relações laborais no plano internacional, capaz de proporcionar a universalização e perenidade de um Direito do Trabalho global.
The purpose of the present investigation is to reexamine the legal, sociological, economic, political, ethical and historical premises used by humanity to construct a global system of production that cannot and cannot universalize minimum labor rights. The objective of this method is to gather elements of conviction able to justify the creation of a new cultural paradigm, to motivate the proposition of legal solutions leading to the realization of social justice, through the universalization of Labor Law and the global protection of labor relations. At the outset, various socioeconomic models will be analyzed from antiquity to the present, including pack, tribal, imperial, feudal, commercial capitalist, industrial capitalist, and financial capitalist societies, as well as the underlying labor relations. In this way, it will be possible to identify the social value of work in each of the models and the respective distributive justice standard. The aim of this analysis is to overcome any kind of determinism regarding the low degree of social justice resulting from labor relations, trying to affirm, on the contrary, that work and justice can go hand in hand. To demonstrate the plausibility of this hypothesis, some questions regarding anthropological patterns of the inherence or not of justice as a human attribute and its intersection with the factors cooperation and competition will be analyzed. The role of economics, power relations and ethics as contributing elements to the formation of fairer and more equitable societies will also be investigated. Once verified how these factors act as conditions of social justice in labor relations, the research will try to demonstrate the need for law intervention in three aspects: regulation, supervision and judicial protection. In this way, it will start from the regulatory models from antiquity, namely slavery, servitude and craft corporations, until wage-earning, with the birth of Labor Law, as a branch of legal science. From the state model of regulation of industrial relations, we will study the international rules, especially the norms coming from the International Labor Organization. Due to its worldwide importance and legitimacy, the ILO will be the object of a detailed study, going through its functional structure, normative species, characteristics of its norms and propaedeutic framework, as well as its legislative process and the integration of its norms in national legal systems. In the end, a succinct diagnosis will be made critical to its regulatory model, both in relation to the legislative process and the effectiveness of its rules. Still under the regulatory bias, will be investigated the interrelationship of labor rights with human rights and the hypothesis of international regulation through the insertion of labor clauses in international trade treaties. In the area of labor relations supervision from an international perspective, the supervisory controls on the application of ILO norms, carried out permanently, by provocation and the special control of freedom of association, carried out by their internal bodies, will be examined in detail. your sphere of attribution. The effectiveness of this supervisory system will be made in comparison with the Brazilian Labor Reform of 2017, so that, in a specific case, its qualities, deficiencies and limits can be gauged. The possibility of safeguarding labor rights at the global level will be undertaken from the examination of its current international judicial protection, from the regional human rights courts, the ILO Administrative Court, the WTO dispute settlement bodies and the Court. Justice, up to the jurisdiction of the States. Labor rights protection will also be appreciated on the basis of some existing proposals for the establishment of an international human rights tribunal. Finally, it will be proposed to set up an international labor court and an international labor prosecutor as autonomous international bodies, even if linked to the ILO. The first with international jurisdiction to uphold international labor rights ratified in the signatory countries, with consultative and contentious competence. The second is to sue this guardianship before the aforementioned court or in non-contentious form with the defendants. In this way, the virtuous circle of regulation, supervision and supervision of labor relations at the international level, capable of providing the universalization and continuity of a global Labor Law, will be complete.
