Crises, Estado e Precariedade Laboral: o Trabalho Temporário em Portugal

Abstract

O tema das crises regressou ao palco do pensamento económico e sociológico na última década à medida que se agravaram e multiplicaram as suas causas e se tornam visíveis os seus resultados. Da crise financeira à crise social, da crise ecológica à crise de representação política, os elementos de inflexão das regras e comportamentos estão presentes e afetam diversas dimensões das dinámicas e estruturas sociais. À luz dessa transformação, duas esferas em particular serão alvo de questionamento nesta tese. A esfera do Estado e a esfera do trabalho. O tema desta tese é o papel do Estado na regulação das relações laborais em contexto de crise. Uma análise ancorada no fenómeno de precarização das relações laborais em geral, e no fenómeno do trabalho temporário de agência em particular. Para a compreensão deste tema, partimos de uma ampla gama de referências teóricas com base nesta tríplice conceptualização: do Estado como arena de conflitos: do trabalho como esfera central de reprodução e estruturação; da crise como elemento acelerador dos processos de reconfiguração social. Segue-se uma análise das transformações sociais atinentes ao nível do Estado e do trabalho em Portugal, valorizando diferentes períodos até atualidade. O debate em torno do tema do atraso e as análises do fenómeno de precarização laboral adquirem particular relevo nesta parte. Esta investigação aborda em pormenor o fenómeno do trabalho temporário de agência. Primeiro, desde uma perspectiva internacional, situando a sua génese e posterior desenvolvimento. Depois, no contexto português, identificando a formação, crescimento e afirmação do sector. O trabalho temporário de agência adquiriu uma relevância incontornável nos últimos anos, pontuando em praticamente todas as análises que trabalham o fenómeno da precariedade laboral. Por apresentar características distintivas no que concerne à instabilidade dos vínculos, baixos salários e força de trabalho mobilizada, o trabalho temporário figura como um caso singular na regulação laboral estabelecida pelo Estado. A análise do trabalho temporário é realizada a partir da mobilização de diversas fontes e indicadores, procurando estabelecer uma conexão analítica com os temas do Estado, do trabalho e das crises.

The crisis has returned to the center of economic and sociological thinking in the last decade as its causes have worsened and multiplied and its results become visible. From the financial crisis to the social crisis, from the ecological crisis to the political representation crisis, the elements of inflection of rules and behaviors are present and affect different dimensions of social dynamics and structures. In the face of this transformation, two spheres in particular will be questioned in this thesis. The sphere of the State and the sphere of work. The subject of this thesis is the state's role in the regulation of labor relations in the context of crisis. An analysis anchored in the phenomenon of labor precariousness in general, and in the phenomenon of temporary agency work in particular. For the analysis of this subject, we start from a wide range of theoretical references based on this threefold conceptualization: of the State as an arena of conflicts: of work as a central sphere of reproduction and structuring; crisis as an accelerating element in the processes of social reconfiguration. This is followed by an analysis of the social transformations related to the State and labor in Portugal, valuing different periods until today. The debate around the issue of backwardness and analyzes of the phenomenon of precariousness are particularly important in this part. This research discusses in detail the phenomenon of temporary employment agency. First, from an international perspective, placing its genesis and subsequent development. Then, in the Portuguese context, identifying the formation, growth and affirmation of the sector. Temporary agency work has acquired an unavoidable relevance in recent years, punctuating in almost all analyzes that work the phenomenon of precarious work. By presenting distinctive features regarding the instability of contracts, low wages and mobilized workforce, temporary work stands as a unique case in labor regulation established by the state.
