Abstract: The present dissertation investigates the frontier spaces (or the limits of law) reflecting on alternatives that promote, through translation, the intercultural dialogue between the West and Islam. Given the set of human realities that we live today, let me begin. underlining that I propose (at the limit) a challenge involving the problem of interculturality, the experience of law and the irreversible presence of cosmopolitanism — overflowing with it an unquestionable infinity of problems and complexities. The difficulties that emanate from the dialogue between cultures, especially when mobilized in terms of identities and civilizational realities (placing specifically distinct demands and particularities), promptly lead to a clarification. Firstly, I must say that the position taken here is not global. The stage of the civilizational realities that I propose (with the effect and framing that we want here) imposes itself on the singularity of analyzing two actors. Two great actors. For when I propose to address the law and the problem of dialogue between cultures, I do so with the intentional specificity of facing the controversial legally relevant relationship between the West and Islam. And as if that weren't enough, a warning signal sounds when various interpositions synthesize ways of responding to the common problem of the mundane situation — looking for a specifically mapped and often fallible orientation because it is a certain (or partial) solution fed from the constitutive aegis of this or that civilizational horizon. What happens then is something difficult to articulate, because in the wake of this alert lies an important record that is a quasi-bookkeeping (of the present time) that is metaphysically inseparable.
A presente dissertação investiga os espaços de fronteira (ou os limites do direito) refletindo sobre alternativas que promovam, por meio da tradução, o diálogo intercultural entre o Ocidente e o Islão. Dado o conjunto das realidades humanas que vivemos hoje, permitam-me começar sublinhando que proponho (no limite) um desafio envolvendo o problema da interculturalidade, da experiência do direito e da presença irreversível do cosmopolitismo — transbordando daí uma inquestionável infinidade de problemas e complexidades. As dificuldades que emanam do diálogo entre culturas, especialmente quando mobilizados no plano das identidades e das realidades civilizacionais (colocando exigências e particularidades especificamente distintas), solicitam de imediato um conducente esclarecimento. Em primeiro lugar, preciso dizer que a tomada de posição aqui não é global. O palco das realidades civilizacionais que ora proponho (com o efeito e enquadramento que aqui se quer) se nos impõe na singularidade de analisar dois atores. Dois grandes atores. Pois quando proponho tratar do Direito e o problema do diálogo entre culturas, faço-o com a especificidade intencional de enfrentar a polêmica relação juridicamente relevante entre o Ocidente e o Islão. E como se não bastasse, um sinal de alerta soa quando as mais variadas interposições sintetizam formas de resposta ao comum problema da situação mundanal — procurando uma orientação especificamente mapeada e muitas vezes falível, por conta de ser uma (...)
