Resumo: Objetivou a pesquisa que norteou esta dissertação refletir sobre o instituto das sesmarias, seu surgimento e vigência em Portugal e, sua transplantação para o Brasil colónia. A partir da expansão marítima Portugal precisou encontrar formas de povoar os territórios encontrados, e para isso aplicou o instituto das Sesmarias, primeiramente nas Ilhas Atlânticas e, depois, no Brasil. No presente trabalho, analisaram-se os institutos jurídicos e costumes antecedentes à promulgação da Lei das Sesmarias em Portugal, bem como as mutações que a mesma sofreu ao ser incorporada nas Ordenações Afonsinas, Manuelinas e Filipinas. Em relação ao Brasil, observaram-se as mudanças atinentes ao instituto nas terras brasílicas, e o seu modo de implantação, delineado pelo sistema das capitanias hereditárias e, posteriormente, do Governo Geral, bem como as mudanças sofridas pela legislação através de disposições esparsas, o Alvará de 5 de outubro de 1795, até a sua suspensão em 1822. Analisou-se a sua vigência no campo fático, ao percorrer as cartas de sesmaria, os relatos de sesmeiros contidos nelas, e os procedimentos para concessão, bem como, os requisitos essenciais para a sua regularização e as mudanças dos mesmos ao longo do tempo. Por fim, examinou-se a Lei de 1850, chamada “de terras”, promulgada com quase 30 anos de atraso depois da suspensão das sesmarias, que almejou regularizar as posses e sesmarias caducadas e substituiu a distribuição das terras da Coroa através das sesmarias pelo sistema de compra.
The research that guided this dissertation aimed to reflect about the "sesmarias" institute, it's emergence and termination in Portugal and its introduction to Colonial Brazil. From the start of the portuguese maritime expansion, the kingdom of Portugal needed to find a way to populate the found territory, and for that applied the “sesmarias”, a antique medieval institute used to distribute unused land, first on the atlantic islands, and later, in Brazil. In the present work, the legal institutes e the costumes previous to de promulgation of de Sesmarias Law in Portugal were analysed, as well as the mutations that the law suffered on the incorporation to the Afonsinas, Manuelinas and Filipinas Ordenations. In what regards of Brasil, were observed the application of the sesmarias outlined by the hereditary captaincies system and, after, by de General Government, as well the changes suffered from the sparse legislation, the 1795 law, until its suspension in 1822. Its operation on the real life were analysed by the investigation of the “sesmarias” letters and the reports of the "sesmeiros" that were found inside them, the procedures for the land concessions, as well as the essentials requirements for its regularization and its changes over time. Finally, were examined the 1850 law, called "of land", that came with almost thirty years of delay which aimed to regularize the possessions and the expired “sesmarias” and replaced the land distribution of the kingdom through the "sesmarias" for the purchase system.
