Abstract: A independência de Angola e a ainda breve história constitucional angolana não significaram o fim dos costumes da população nativa angolana. O ordenamento jurídico-constitucional angolano, por virtude da consagração do costume como fonte imediata do direito, nos termos do artigo 7.º da Constituição da República de Angola de 2010, assume uma posição realista que não ignora o que efectivamente vigora em muitas partes do território. Este “reconhecimento” constitucional do costume veio introduzir uma profunda alteração na tipologia das fontes do direito angolano, num quadro de pluralismo jurídico que admite a existência de um direito fora do direito do Estado, isto é, um direito de fonte não estatal. No âmbito do direito penal, o desafio passa por encontrar caminhos que facilitem a convivência entre os sistemas costumeiros consolidados e o sistema jurídico subordinado ao Estado que tem como garantias constitucionais o princípio da legalidade da intervenção penal, os direitos fundamentais e a dignidade da pessoa humana.
The independence of Angola and the Angolan still brief constitutional history don´t imply the end of the customs of the native population. The Angolan constitutional order, with the provision of the custom as an immediate source of law under the article 7 of the 2010 Constitution of the Republic of Angola, adopts a realistic position that does not ignore what actually prevails in many parts of the territory. This constitutional “recognition” of the custom has introduced a profound change on the typology of the Angolan law sources, with a legal pluralism framework that acknowledges the existence of rights outside the rule of law, i.e., a non-state source of law. Under the criminal law, the challenge is to find ways to facilitate the coexistence between consolidated customary systems and the legal system subordinated to the state whose constitutional guarantees include the principle of legality in criminal law, fundamental rights and human dignity.
