Abstract: Esta dissertação faz uma análise do elemento de conexão residência fiscal no âmbito do imposto português sobre o rendimento das pessoas singulares, com uma abordagem especial acerca da sua parcialidade, que se traduz na possibilidade de a residência fiscal ser inferior ao período anual. A residência fiscal é o principal elemento de conexão utilizado pelos Estados para tributar os rendimentos dos sujeitos singulares. Mas as diferentes configurações deste elemento pelos vários países podem levar aos fenômenos da dupla tributação ou da dupla não tributação, com os efeitos negativos para a mobilidade internacional e para a base tributária dos Estados, respectivamente, para além da desigualdade gerada entre os sujeitos. No ano de 2015, Portugal alterou a legislação para incluir no seu ordenamento jurídico o regime parcial de residência fiscal, em substituição ao regime anual, embora este permaneça de modo mitigado. Os objetivos da inclusão do regime parcial convergem para o combate à dupla tributação e à dupla não tributação. Este trabalho se propõe a abordar as atuais regras de residência fiscal e as questões solucionadas, mitigadas ou criadas pela inclusão do regime parcial de residência fiscal em Portugal. No âmbito interno, colocam-se questões relacionadas às retenções na fonte e aos pagamentos antecipados, aos prazos de declaração, à aplicação das taxas e das deduções, à tributação conjunta, aos rendimentos acumulados e ao prazo de caducidade da liquidação. No plano internacional, levantam-se questões relativas à aproximação da residência à realidade, à solução da dupla não residência, aos comentários do Modelo de Convenção da OCDE, à diminuição das duplas residências e à aplicação das convenções contra dupla tributação.
This dissertation makes a analysis of the connection element tax residence within the scope of portuguese income tax, with a special approach to its splitting, which translates into the possibility of a tax residence less than the annual period. Tax residency is the main connecting factor used by the States to tax the income of individuals. But the different configurations of this element by the various countries can lead to the phenomena of double taxation or double non-taxation, with negative effects on international mobility and the tax base of States, respectively, in addition to the inequality generated between the subjects. In the year 2015, Portugal amended the legislation to include in its legal system the split regime of tax residence, replacing the annual regime, although this remains in a mitigated way. The objectives of the inclusion of the split regime converge to combat double taxation and double non-taxation. This paper proposes to address the current rules of tax residence and the issues solved, mitigated or created by the inclusion of the split regime of tax residence in Portugal. On the domestic front, issues related to withholding taxes and prepayments, deadlines for return, application of rates and deductions, joint taxation, accumulated income and expiry of the right of assessment. At the international level, questions arise regarding the approximation of residence to reality, the solution of double non-residence, the comments of the OECD Model Convention, the reduction of double residences and the application of double taxation conventions.
