Abstract: A União Europeia é fundada numa economia de livre mercado e ampla concorrência. Os Estados membros da União são economias mistas em que o livre mercado convive com a intervenção estadual subsidiária. As intervenções do Estado na economia se fazem necessárias quando o mercado não consegue suprir todos as necessidades da sociedade, o que, no âmbito europeu, se traduz no interesse comum. Uma das formas de intervenção dos Estados na economia é a concessão dos auxílios de estado, que consistem em vantagens concedidas pelo ente público, decorrentes de recursos públicos, a certas empresas determinadas, de forma que isso, por sua seletividade, afeta a ampla concorrência. No âmbito europeu, as intervenções do Estado na economia estão sujeitas aos princípios contidos nos Tratados da Europa, e ao controle pela União. O Tratado de Funcionamento da União Europeia veda a concessão de auxílios de estado por sua incompatibilidade com a concorrência do mercado interno. No entanto, por império do interesse comum europeu, a incompatibilidade dos auxílios pode ser afastada em casos específicos, com cumprimento de diversos requisitos, previstos pelo próprio Tratado e por Regulamentos que a ele seguiram. O controle da concessão dos auxílios e a verificação de sua compatibilidade ou não com o mercado é realizado pela Comissão e passível de revisão judicial pelo Tribunal. Uma das exceções à incompatibilidade com o mercado interno é a concessão de auxílios à cultura e conservação do patrimônio, em que o interesse comum se sobrepõe ao império da livre concorrência. A cultura e a conservação do património são objetivos da própria Europa de tal forma que a concessão de um auxílio para estes fins, desde que cumpridos todos os requisitos necessários, é considerada compatível com o mercado interno.
The European Union is based on a free-market economy with wide competition. The Member States of the Union are mixed economies in which the free market coexists with the subsidiary state intervention. State interventions in the economy are necessary when the market fails to meet all the needs of the society, which, at the European level, translates into the common interest. One of the forms of state intervention in the economy is the granting of State aid, which consists in advantages granted by the public entity to public undertakings by certain enterprises, so that this selectivity affects the wide competition. At the European context, State interventions in the economy are subject to the principles contained in the Treaties of Europe and to the control of the Union. The Treaty on the Functioning of the European Union prohibits state aids because it is incompatible with the internal market competition. However, by virtue of the European common interest, the incompatibility of the aid may be disregarded in specific cases, subject to various requirements specified by the Treaty and by the Regulations that followed it. The control of the granting of state aids and the verification of its compatibility or not with the market is carried by the Commission and subject to judicial review by the Court. One of the exceptions to the state aids incompatibility with the internal market is the granting of aids for the culture and heritage conservation, where the common interest overrides the rule of free competition. The culture and the heritage conservation are among the objectives of Europe therefore the granting of aid for those purposes, taken that all the necessary requirements are met, is considered compatible with the internal market.
