O Papel dos Municípios na Defesa de Bens Imóveis de Interesse Cultural

Abstract

O presente Relatório de Estágio enquadra-se no âmbito da obtenção do grau mestre em Administração Público-Privada, através da Faculdade de Direito da Universidade de Coimbra, sendo composto por duas partes. A primeira parte aborda, de forma breve, o meu período de estágio, realizado na Comunidade Intermunicipal do Oeste (OesteCIM) e a segunda parte, mais extensa, constitui uma componente científica sobre o papel dos municípios na defesa de bens imóveis de interesse cultural. Para esta, a metodologia adotada foi essencialmente a pesquisa bibliográfica.Num mundo em que a globalização impera, a sociedade foi impelida, durante anos, a adotar hábitos “estandardizados” e a renunciar tradições típicas das suas regiões, negligenciando assim o seu Património. Contudo, este legado faz parte da identidade de um povo, sendo um importante valor cultural a preservar, além de constituir um recurso económico de elevado potencial para alavancar o desenvolvimento local. Assim, para se tirar o maior partido do património, é necessário a elaboração de planos estratégicos em que se compatibilizam os meios de salvaguarda do património cultural com as necessidades locais, sendo a autoridade com maior capacidade de alinhar estas matérias as autoridades locais, pois conhecem bem o território, a população e os seus recursos.A componente científica deste trabalho, confinando o seu âmbito ao património imóvel de interesse municipal, tem como principais objetivos promover a preservação e valorização destes bens e, tendo por base a legislação nacional, constituir uma ferramenta de consulta que apresenta os principais métodos aos quais as Câmaras Municipais podem recorrer para assegurar a sua salvaguarda.Como tal, aborda as opções de salvaguarda de património imóvel de interesse municipal através da classificação dos bens e por via dos planos municipais de ordenamento do território.

The following report was written in order to achieve my master's degree in Public and Private Administration by the Faculty of Law of the University of Coimbra. The report consists of two parts. The first part is a brief approach to my internship, held for five months at the Portuguese Intermunicipal Community of the West (OesteCIM) and the second part, which is more extensive, is a scientific component focused on the role of municipalities in the defense of real estate of cultural interest. For this last part, the main methodology adopted was bibliographic research.In a world in which globalization prevails, society was impelled, for years, to adopt "standardized" habits and to renounce the typical traditions of its regions, thereby neglecting its Patrimony. However, this legacy is part of people’s identity, an important cultural value to be preserved, as well as an economic resource of great potential to leverage local development.Thus, in order to make the most out of cultural heritage, it is necessary to draw up strategic plans that reconcile the means of safeguarding the cultural heritage with local needs, the local authorities being the ones with the greatest capacity to align these matters due to their knowledge of the territory, the population and its resources. The scientific component of this assignment, confining its scope to real estate of municipal interest, has two main objectives: the promotion of the preservation and appreciation of these assets and based on national legislation, seek to present the main methods available to which the Municipalities may resort to ensure that their real estate is safeguarded. Consequently, it addresses safeguarding real estate of municipal interest via classification of goods and through municipal territory plans.
