A discriminação no acesso ao arrendamento a detentores de animais de companhia

Abstract

This work intends to make known the existing controversy in what the animal cause concerns. It is its objective to raise awareness of the current state of animal protection and the controversy about animal rights in our legal system and abroad. As so, it will start an investigation around the pioneer countries in the changing of the animals’ legal status over time. It emphasizes the legislative evolution in Portugal, consecrating the current position occupied by animals, being that, throughout all investigation, it will be made a critic reflection to the law and its protection to animals. Even more, it has the purpose to bring to the debate issues that resemble more frequent and, that for which, there is no legal answer. We are talking about renting contracts that prevent lessees from taking their pets with them. As so, future lessees when confronted with these situations feel constrained and, many times feel helpless, because there are not many solutions left. Finally, once all the work takes into account the increasing concern of society on animal rights and animals defense, it ends with a proposal to amend Projeto-lei n.º 296/XIII/1ª, which aims to ensure equal access to lease by pet owners. Este trabalho pretende dar a conhecer a controvérsia existente no que à causa animal concerne. É seu objetivo dar a conhecer o estado atual da defesa animal, da polémica sobre os direitos dos animais, no nosso ordenamento jurídico e no estrangeiro. Assim, começa por uma investigação em volta dos países pioneiros na alteração do estatuto jurídico dos animais ao longo dos tempos. Salienta a evolução legislativa em Portugal, consagrando a atual posição ocupada pelos animais, sendo que, no decorrer de todo o trabalho será feita uma reflexão crítica à lei e à sua proteção para com os animais. Mais ainda, tem como propósito trazer a debate questões que se mostram cada vez mais frequentes e, para as quais, não há resposta legal. Falamos de contratos de arrendamento que vedam os arrendatários de levarem consigo animais de companhia. Assim, os futuros inquilinos quando confrontados com estas situações vêem-se inferiorizados e, muitas das vezes desamparados, pois poucas são as soluções que lhes restam. Por fim, uma vez que todo o trabalho tem em conta a cada vez maior preocupação da sociedade com o tema dos direitos e defesa dos animais, termina com a apresentação aos leitores de uma proposta de alteração do Projeto-lei n.º 296/XIII/1ª, que visa assegurar a igualdade de acesso ao arrendamento por quem possui animais de companhia.
