dc.description.abstract | No decorrer de actos atrozes de terrorismo com os quais somos confrontados regularmente, consideramos imperativa uma análise dos instrumentos internacionais adequada e compatível com o período hodierno. Para tal, propomos uma recondução dos actos mais atrozes do terrorismo aos crimes contra a humanidade, previstos no art. 7.º do Estatuto de Roma, uma vez considerarmos que, não é somente viável, como desejável garantir a competência do Tribunal Penal Internacional para os casos mais sérios deste tipo de violência. Para tal, numa tentativa de melhor explanação do tema, houve que fazer uma prospecção dos antecedentes históricos de cada um destes crimes, assim como das características típicas dos ilícitos em causa para, bem assim, empreender uma possível recondução dos actos de terrorismo a infracções típicas constitutivas dos crimes contra a humanidade, nomeadamente o homicídio, o extermínio, as perseguições e os outros actos desumanos. Não se menosprezou, no entanto, a abordagem de temas controversos do Direito Internacional Penal, nomeadamente, a divergência de tratamento da problemática que versa sobre os movimentos de libertação nacional, uma vez que a justiça da causa parece, para alguns autores, justificar os meios empregados, fazendo jus ao mote "illegal but justifiable – conduta que, no nosso parecer, poderá ser desculpável de acordo com alguns critérios; nem tão pouco a questão da decisão do Tribunal Especial para o Líbano, compreendendo que, não sendo uma posição maioritária na doutrina e na jurisprudência, é o começo de uma possível mudança de paradigma. | por |
dc.description.abstract | As a result of atrocious acts of terrorism, which we are regularly confronted with, we consider imperative that an analysis of international instruments to be adequate and compatible with the current period. In order to achieve this aim, we propose a reconduction of the most atrocious acts of terrorism to crimes against humanity, foreseen in art. 7.º of the Rome Statute, once we consider that it is not only feasible, but also desirable, to ensure the competence of the ICC to the most serious cases of this type of violence. Therefore, in an attempt to provide a better explanation of the subject, it was necessary to investigate the historical background of each one of these crimes, as well as to recognize their typical characteristics, so we could provide a possible lead back of those acts of terrorism to typical offenses constituting crimes against humanity, namely murder, extermination, persecution and other inhumane acts. However, the approach to controversial issues of International Criminal Law, such as the divergence of treatment of national liberation movements’ problem, has not been underestimated, since the justice of the cause defended seems, for some authors, to justify the illegal means employed, doing justice to the motto “ilegal but justifiable” - conduct which, in our opinion, may be excusable according to some criteria; neither does the issue of the decision of the Special Court for Lebanon.
