Estagnação do direito sucessório português vs perspetiva de mudança: o projeto de lei 781/XIII

Abstract

O direito das sucessões é o tema central da presente dissertação. Analisa-se desde aspetos gerais a aspetos específicos. Após um estudo da sucessão legal primordial que tem sido alvo de diversas críticas, explana-se o fundamento que leva esta sucessão a ser uma restrição ao direito de propriedade privada, plasmado constitucionalmente. No entanto, o fundamento legal que leva ao entendimento do limite imposto não se encontra atualizado, pelo que se defende que o direito sucessório português carece de uma revisão legislativa a vários pontos. Um mecanismo que tem avançado positivamente nas diversas fases do procedimento legislativo é o Projeto de Lei 781/XIII, que visa alterar o código civil, em matéria do direito sucessório, no que toca à possibilidade de renúncia recíproca à condição de herdeiro legal na convenção antenupcial. É, portanto ainda, o intuito deste estudo analisar este mecanismo legislativo e criticá-lo. E saudar a iniciativa legislativa que visa modificar este direito estagnado há diversos anos. . . . . .

The law of succession is the central theme of this dissertation. It is analyzed from general aspects to specific aspects. After a study of the primordial legal succession which has been the subject of a number of criticisms, it explores the foundation that leads the legitimized succession to be a restriction on the private property right, constitutionally shaped. However, the legal basis that leads to the understanding of the restriction is not updated, so it is the reason why it is defended that the portuguese succession law needs a legislative revision on several points. One mechanism that has made good progress at various stages of the legislative procedure is the Law Project 781/XIII, which seeks to amend the civil code, in terms of succession law, as regards the possibility of reciprocal waiver of the status of legal heir in the pre-nuptial agreement. It is, therefore, still the intention of the study to analyze this legislative mechanism and criticize it. And welcome the legislative initiative which aims to change this stagnant right to several years. . . . . .
