Direito comparado: análise e confronto dos julgados de paz portugueses e juizados especiais cíveis brasileiros

Abstract

O presente estudo tem como objetivo a análise comparativa entre dois importantes tribunais: os Julgados de Paz portugueses e os Juizados Especiais Cíveis brasileiros. Pretende-se ainda proceder a uma análise continuamente confrontada de suas estruturas, fundamentos e demais elementos de suas composições, para que, então, sejam efetivamente verificadas e destacadas suas semelhanças e divergências. Objetiva-se também colaborar com dados e estudos relativos à matéria selecionada, sobretudo no que tange à proximidade entre o Direito Português e o Direito Brasileiro. Desta forma, conclui-se que, embora suas semelhanças sejam inúmeras, os tribunais não exerceram influência sobre a criação do outro, tendo sido anotadas também algumas diferenças, considerando que a que possui mais destaque é a ausência de força executiva dos Julgados de Paz. .

The present study aims at comparative analysis between two important courts: the Portuguese Peace Courts and the Brazilian Civil Courts.It is also intended to carry out a continually confronted analysis of their structures, fundamentals and other elements of their compositions, so that their similarities and divergences are effectively verified and highlighted.It is also intended to collaborate with data and studies related to the selected subject, especially regarding the proximity between Portuguese Law and Brazilian Law.In this way, it is concluded that, although their similarities are numerous, the courts did not influence the creation of the other, and some differences were also noted, considering that the one that most stands out is the lack of executive force of the Peace Courts. .
