No fundo o que está em causa é saber se, numa situação em que intervém (na realização do facto criminoso) uma pluralidade de agentes, a tentativa se inicia para todos em simultâneo mesmo que apenas um tenha dado início à execução do crime, ou se pelo contrário devemos atender ao contributo individualmente considerado de cada co-autor, começando por isso a tentativa apenas no momento em que ele pratica o primeiro acto de execução do crime. O presente trabalho tem assim por objecto o estudo destas duas hipóteses e a sua relevância jurídico-penal na determinação de um critério jurídico que nos permita delimitar o início da tentativa do co-autor.Com a presente investigação pretende-se dar resposta a um problema específico da comparticipação criminosa que surge em torno da co-autoria, nomeadamente face aos problemas que se colocam aquando da determinação do início da tentativa do co-autor no Direito Penal Português. This research work intends to address a specific issue related to criminal co-participation that arises from co-offending, specifically in view of the challenges faced while determining the beginning of the co-offender's attempt under Portuguese Criminal Law. In fact, what is at stake is knowing if, in a situation in which there are multiple agents involved (in an actual criminal offense), the attempt begins for all at the same time, even if only one of them began committing the crime or if, on the contrary, we should take into account each co-offender's individual contribution, thus considering that the attempt only begins at the time when he/she commits the first criminal act.
