Abstract: A presente dissertação tem como objetivo a análise da aplicação do princípio da periodização económica previsto no Código do Imposto sobre o Rendimento das Pessoas Coletivas (CIRC). Este estudo analisa as diferentes interpretações proferidas pelos tribunais relativamente ao referido princípio, procurando confrontar os pressupostos utilizados pela Autoridade Tributária (AT) e as contra-alegações dos contribuintes. Por outro lado, procura-se averiguar em que situações é possível invocar o princípio da justiça, com o intuito de evitar a ocorrência de uma correção injusta para o contribuinte. A investigação centra-se numa análise crítica dos diversos acórdãos provenientes de quatro tribunais portugueses (TCAS, TCAN, CAAD e STA), procurando identificar as tendências das decisões destes tribunais e descobrir um caminho orientador para a correta interpretação das exigências legais. Deste modo, o presente estudo não consiste numa simples revisão da literatura em relação à aplicação do princípio da periodização económica, mas também se relaciona com uma profunda análise jurisprudencial dos requisitos normativos subjacentes a este princípio. Conclui-se da análise jurisprudencial realizada que existe, de um modo geral, uma ligeira tendência para a declaração de ilegalidade das liquidações adicionais de imposto realizadas pela AT. Assim, embora ocorra o incumprimento do princípio da periodização económica, as correções efetuadas pela AT não podem resultar em uma situação de injustiça, o que gera várias decisões dos tribunais a favor do contribuinte.
The purpose of this dissertation is to analyse the application of the principle of economic periodization established in the Corporate Income Tax Code (CIRC). This study analyses the different interpretations issued by courts in relation to that principle, seeking to confront the assumptions used by the Tax Authority (TA) and the claims of the taxpayers. On the other hand, this study tries to find out in which situations it’s possible to summon the principle of justice, with the purpose of avoiding the occurrence of an unfair correction for the taxpayer.The investigation focuses on a critical analysis of different judgments from four portuguese tax courts (TCAS, TCAN, CAAD and STA), trying to identify the tendencies of the decisions of these courts and to discover a leading path for the correct interpretation of the legal requirements. Thereby, the present study doesn’t consist on a simple review of the literature about the application of the principle of economic periodization, but also includes a deep judicial tax analysis of the normative requirements underlying this principle.From the judicial tax analysis made, it’s possible to conclude that there is, in general, a slight tendency towards the declaration of illegality of the additional tax assessments carried out by the TA. Thus, although there is a breach of the principle of economic periodization, corrections made by the TA cannot result in a situation of injustice, which generates several decisions of the courts in favour of the taxpayer.
