dc.description.abstract | A presente Dissertação de Mestrado tem como objetivo analisar o crime de Associação Criminosa previsto e punível pelo artigo 299.º do Código Penal. Assim, para o efeito, aquilo que se pretende é fazer uma abordagem do seu conceito ao longo da história, questionando o que leva o homem comum a deslumbrar-se com sociedades organizadas com vista à prática de crimes.Concretamente, analisam-se os argumentos históricos, as modalidades e as formas especiais de aparecimento que definem o tipo de crime, bem como a organização propriamente dita, se é que assim lhe podemos chamar.Com este intuito, será feita uma análise crítica à forma como a jurisprudência e a doutrina se comportam nesta temática, que, como será visto, divergem uma da outra. Utiliza-se para isso um acórdão jurisprudencial do tema.Apreciado o mesmo, conclui-se que, no caso concreto, nos encontramos perante a figura de comparticipação criminosa, utilizando o suporte da doutrina para retirar tal conclusão.
