Este expediente legal costuma gerar estranhamento aos aplicadores do direito dos sistemas de matriz continental-europeia, como Brasil e Portugal, muito ligados à ideia de jurisdição, e avessos às práticas negociais. A preocupação fulcral dá-se em torno dos direitos e garantias constitucionais, sobretudo, aquelas relativas ao processo. Nesse sentido, por se tratarem de ordenamentos regidos pelo princípio da obrigatoriedade ou da legalidade, e a ideia de uma negociação entre as partes está atrelada à autonomia da vontade, isto é, ao arbítrio das partes, parece óbvio a correlação deste instituto com o princípio da oportunidade, deste modo o presente trabalho se propõe ao estudo desta principiologia para determinar se a delação premiada é, de fato, uma manifestação deste último. Há também grande preocupação acerca da legitmidade do prêmio, bem como, ao respeito às garantias do acusado. No Brasil, a Lei 12850/13 entrou em vigor, e colocou a doutrina em debate, tendo em vista que suscitou inúmeros problemas acerca do assunto. O presente estudo dedica-se, entre outras coisas, a estudar esta legislação, bem como à formulação de soluções para as questões surgidas como: a possibilidade do acordo de imunidade, ou quem seriam os legitimados à propositura do acordo, bem como a questão sobre a renúncia ao direito ao silêncio, e a possibilidade ou não de o colaborador atuar como testemunha e réu no mesmo processo, entre outros. Na verdade, este trabalho ultrapassa a análise meramente legislativa, tendo em vista o enorme universo que compreende o objeto de estudo. The award-winning is an institute of “Premial Criminal Law”, which has as main characteristic the negociation between the police or prosecutor and the delinquent, and it consists in an incentive through the concession of a legal award conferred on the person who commitment to collaborate with "Justice". This legal file usually generates strangeness to the applicators of the law of the Civil Law System, such as Brazil and Portugal, it closely linked to the idea of jurisdiction, and averse to bargaining practices in the penal procedure. The main concern about this subject it is constitutional rights and guarantees, especially those related to the penal procedure. In this sense, because they re legal systems ruled by compulsory or legality principle, and the idea of a negotiation between different sides is linked to the will autonomy, in other words, at the contractors discretion it seems obvious the correlation of this institute with the opportunitu principle, in this way, this work is proposed to study this principiology in the direction to determine if the award-winning is, in fact, a manifestation of it. There is also an important concern about the legitimacy of the award and the respect of guarantees of the accused. In Brazil, Law 12850/13 came into force, and put the doctrine into debate, in view of which it raised numerous problems on the subject. The present study is dedicated, among other things, to study this legislation and formulating solutions to issues that have arisen as: the possibility to signing an immunity agreement, or to respond who would be legitimated to celebrate an agreement, or the question about the renunciation of the right to silence, and the possibility or not of the collaborator to act as witness and defendant in the same penal procedure, etc. Actually, it goes beyond the merely legislative analysis, considering the enormous universe that comprises the object of study. |
