O problema da configuração do nexo de causalidade nas ações que envolvem a responsabilidade civil do médico

Abstract

RESUMO Uma das tarefas mais complexas para que seja configurada a responsabilidade de um certo sujeito é estabelecer um justo critério para que o comportamento dele possa ser ligado a um determinado dano, isto é, estabelecer um elo de ligação entre a conduta do lesante e a lesão sofrida pelo lesado. Tal elo de ligação, que é tradicionalmente denominado por nexo de causalidade, fica mais difícil de ser configurado nos casos que envolvem a responsabilidade civil do médico, uma vez que nesse âmbito há uma série de fatores imprevisíveis que torna incerto o real acontecimento dos fatos. Por isso, existindo incertezas em relação aos fatos que levam à produção do dano, torna-se problemática a missão de se estabelecer uma ligação entre a conduta do médico e os danos sofridos pelo paciente. Dessa forma, esse estudo pretende analisar as possíveis teorias causais e os mecanismos existentes que tentam solucionar tal problemática e, assim, demonstrar, por meio da aplicação de casos concretos, reais e hipotéticos, a insuficiência deles em resolver essa dificuldade de se determinar a ligação entre a conduta do médico e o resultado danoso sofrido pelo paciente, oportunidade em que se trará como uma possível solução para tal impasse a teoria da imputação objetiva.RESUMO Uma das tarefas mais complexas para que seja configurada a responsabilidade de um certo sujeito é estabelecer um justo critério para que o comportamento dele possa ser ligado a um determinado dano, isto é, estabelecer um elo de ligação entre a conduta do lesante e a lesão sofrida pelo lesado. ABSTRACT One of the most complex tasks for which the responsibility of a certain legal subject is configured is to establish a fair criterion so that his behavior can be linked to a certain damage, that is, to establish a link between the conduct of the injurer and the damage suffered by the injured. Such a connection, which is traditionally called causation, requires a great deal of effort to establish in cases involving the civil liablity of medical doctors since there are a series of unpredictable factors that make the actual occurrence of the facts difficult to determine. Therefore, if there are uncertainties regarding the events that lead to the production of the damage, the mission of establishing a connection between the medical doctor's conduct and the possible damages suffered by the patient becomes problematic. Thus, this study intends to analyze the possible theories of causation and the existing mechanisms that may assist on solving this problem hence demonstrating through the application of real and hypothetic cases that there are insufficient mechanisms to establish a link between the conduct of the medical doctor and the damaging result suffered by the patient.
