O contrato de internamento em lares de idosos

Abstract

A presente dissertação assenta na reflexão acerca dos problemas que o contrato que está na base do internamento em lares de idosos pode suscitar. Começa-se pela análise dos objetivos e dos requisitos legalmente estabelecidos para a abertura, organização e funcionamento de um lar, para depois se focarem as questões que o dito contrato implica, dada a inexistência de regulamentação legal deste tipo de vínculo contratual e a particular sensibilidade dos interesses dos utentes – idosos ou pessoas, com idade avançada ou não, mas com capacidade diminuída -, interesses intimamente relacionados com os seus direitos fundamentais. 2. Para tanto, são estudadas as principais questões que surgem em torno do contrato: por quem pode ser celebrado, o seu conteúdo e as obrigações daí advenientes para os contraentes; para, de seguida, e com apoio nestes elementos, se discutir a natureza deste tipo de contrato e o regime a que haverá de submeter-se. Abordam-se, ainda, hipóteses de incumprimento contratual. 3. Conclui-se mediante pronúncia acerca da qualificação jurídica do contrato e demonstração da necessidade da sua regulamentação legal, sugerindo-se possíveis soluções. Aqui pretendemos traçar um panorama das questões que, como lhe chamamos, o contrato de internamento em lar de idosos pode suscitar, dada a inexistência de regulamentação legal específica deste tipo negocial. Assim é que iremos abordar quem pode ser parte no contrato, o seu conteúdo, as obrigações daí advenientes para os contraentes, para, seguidamente, com a ajuda de tais considerandos, discutir a natureza e regime aplicável a este tipo de vínculo contratual. Aventar-se-á, ainda, hipóteses de incumprimento contratual ou cumprimento defeituoso. Em sede de conclusão, pronunciar-nos-emos acerca da qualificação jurídica do contrato e procuraremos demonstrar que se impõe uma regulamentação urgente, justa e equilibrada do contrato de internamento em lares de idosos, em que os interesses do utente – pessoa fragilizada em razão da idade ou de doença - possam ser devidamente atendidos e os seus direitos fundamentais assegurados. Afinal, contribuiremos com sugestões de possíveis soluções legais.

This dissertation discusses the problems that may be caused by the contract on which admission to a retirement home is based. It begins by analysing the objectives and legally established requirements for the opening, organization and operation of a retirement home. It then addresses the questions involved in such a contract, given the lack of legal regulations applying to this type of contractual relationship and the particular sensitivity of the interests of the users - the elderly or the disabled people, whether or not they are elderly. These interests are intimately connected to their fundamental rights. 2. The study therefore addresses the key questions arising in relation to the contract: who can enter into it, its content and the obligations on the contracting parties. Based on these elements, it then discusses the nature of this type of contract and the regime to which it will be subject. It also addresses cases of breach of contract. 3. It concludes with a statement about the legal qualification of the contract and a demonstration of the need for it to be legally regulated, with some possible solutions suggested. Here we intend to give an overview of the issues that, as we call it, the accommodation contract at a rest home can raise, given the inexistence of specific legal regulation of this type of contract. This is how we will address who can be party to the contract, its content, the obligations arising therefrom for the contractors, and then, with the help of these recitals, discuss the nature and regime applicable to this type of contractual relationship. Likewise, hypotheses of breach of contract or defective performance shall be disclosed. At the conclusion of the procedure, we will decide on the legal qualification of the contract and we will try to demonstrate that there is an urgent, fair and balanced regulation of the accommodation contract at a rest home, where the interests of the user - a person weakened by age or illness - can be adequately cared for and their fundamental rights ensured. After all, we will contribute with suggestions of possible legal solutions.
