O direito à liberdade de expressão diante do discurso do ódio: um futuro de censura ou de discurso livre?

Abstract

A presente investigação pretende analisar a relação entre o direito à liberdade de expressão e os demais direitos fundamentais diante do discurso do ódio, e os reflexos na atual sociedade democrática, que marcada por disparidades econômicas, sociais e políticas, sofrem com os efeitos da discriminação, do ódio e da violência. Para tanto, abordam-se os contornos teóricos gerais e específicos e as lógicas argumentativas de casos concretos em diferentes sistemas jurídicos, que eventualmente permitam o discurso do ódio ou restrinjam o direito fundamental à liberdade de expressão. Desta feita, pretende-se enfrentar a questão não se limitando somente à proibição de discursos ou à restrição de direitos, baseados em regulações estatais ou técnicas de ponderação, mas trazer uma reflexão sobre a necessidade de aprimorar o desenvolvimento da tolerância e das liberdades comunicativas para além de uma atuação política educativa mais eficaz, de forma que gradualmente se formem sociedades mais tolerantes, capazes de reconhecer o multiculturalismo, o pluralismo e o respeito mútuo às diferenças.A presente investigação pretende analisar a relação entre o direito à liberdade de expressão e os demais direitos fundamentais diante do discurso do ódio, e os reflexos na atual sociedade democrática, que marcada por disparidades econômicas, sociais e políticas, sofrem com os efeitos da discriminação, do ódio e da violência.
