Diante disso, o sistema jurídico deve fornecer instrumentos aptos não só ao combate à inatividade normativa do poder público, como também possibilitar que eventuais danos decorrentes desse comportamento passivo possam ser objeto de reparação. A conduta administrativa está vinculada aos direitos fundamentais, isto é, a adoção pelo administrador público de medidas que resguardem ou concretizem tais direitos é verdadeira imposição constitucional. Assim, havendo encargo legal ou constitucional a determinar a expedição de regulamento necessário à fruição de direitos, a passividade normativa da Administração, se injustificada, sinaliza-se como conduta violadora da juridicidade administrativa, pois o poder público de autoridade deve ser utilizado sempre que assim o determinar a ordem jurídica. A inércia, nesses casos, é comportamento ilícito que justifica a propositura de ação reparatória em desfavor do Estado, desde que presentes os dois outros requisitos necessários: o dano e o nexo causal. Deve-se, nos dias atuais, abandonar a exigência de comprovação de culpa na caracterização do dano indenizável decorrente de inércia normativa da Administração, pois a antijuridicidade desse comportamento, por si, já o identifica como fonte de responsabilidade estatal. A ilicitude da inatividade normativa pode decorrer tanto de sua contrariedade às regras jurídicas, quanto de sua incompatibilidade frente aos princípios constitucionais que orientam a função administrativa. Assim, a não expedição de regulamentos administrativos necessários à fruição de direitos é antijurídica por ferir o princípio da proporcionalidade, que coíbe, além do excesso, também a inoperância injustificada, bem como os princípios da eficiência e da moralidade administrativa, que estão a indicar, ambos, que a passividade normativa não é comportamento idôneo ao alcance do bem comum. Failure by the Public Administration to issue regulations imposed by legal order, in addition to revealing inappropriate behavior and violating the idea of good administration, can also cause unfair damages to individuals. In view of this, the legal system must provide suitable instruments not only to combat the normative inactivity of the public authority, but also to enable any damages resulting from such passive behavior to be repaid. Administrative conduct is linked to fundamental rights, that is, the adoption by the public administrator of measures that safeguard or concretize such rights is a true constitutional imposition. Thus, if there is a legal or constitutional charge to determine the issuance of regulations necessary for the enjoyment of rights, the administrative passivity of the Administration, if unjustified, is signaled as a violation of administrative legality, since the public power of authority must be used whenever it is determined by the legal order. Inertia, in such cases, is an unlawful behavior that justifies the proposition of reparatory action in detriment of the State, provided that the other two necessary requirements are present: the damage and the causal link. Nowadays, it is necessary to abandon the requirement of proving fault in the characterization of the indemnifying damage resulting from the normative inertia of the Administration, since the antijuridicity of this behavior, in itself, already identifies it as a source of state responsibility. The illegality of normative inactivity may result both from its contradiction with the legal rules and from its incompatibility with the constitutional principles that guide the administrative function. Thus, the failure to issue administrative regulations necessary for the enjoyment of rights is unlawful on the ground that it infringes the principle of proportionality, which, in addition to overlapping, also precludes unwarranted inefficiency, as well as the principles of administrative efficiency and morality, which indicate, both, that normative passivity is not suitable behavior within the reach of the common good. |
