Com o advento do movimento que reformulou a Administração Pública, o princípio da eficiência tem adquirido cada vez mais importância no ordenamento jurídico mundial, ganhando status constitucional em diversos países. Todavia, os Tribunais Superiores têm apresentado certa resistência na aplicação desse princípio, restando aos Tribunais de Contas a sua efetiva aplicação, já que esses são os responsáveis pela realização das auditorias, que, muitas vezes, requerem a análise técnica baseada em parâmetros de eficiência. É necessário, portanto, saber se as Cortes de Contas de Portugal e do Brasil estão aptas a empregar esse princípio em suas análises, e se estão utilizando-o com o fim de garantir o interesse público. ABSTRACT This paper addresses the issue of the efficiency principle and the Audit Courts in Portugal and Brazil. With the advent of the movement that reshaped the Public Administration, the principle of efficiency has gained increasing importance in the global legal system, gaining constitutional status in many countries. However, the Supreme Courts have shown some resistance in the application of this principle, leaving to the Audit Court the effective application of the efficiency principle, since these are responsible for the conduct of audits, which many times require the analysis of efficiency parameters.
