O contrato de trabalho e a liberdade religiosa

Abstract

A relação empregatícia compõe uma área muito favorável para o alargamento de conflitos pautados na manifestação do fenômeno religioso. O ensaio em resolvê-los, muitas das vezes, tropeça na percepção desajustada da configuração constitucional do direito fundamental à liberdade religiosa. O presente trabalho tem como objetivo a investida de descobrir respostas jurídicas acertadas, com base na legislação brasileira e portuguesa, dos problemas referentes ao exercício da liberdade religiosa em todas as fases do contrato de trabalho. Respalda-se esta investigação na conjetura de que todo indivíduo contratado por uma entidade empregadora traz consigo suas crenças e religião, não sendo possível a dissociação da religião do ser humano religioso, uma vez que sua afirmação no ambiente laboral translada manifesta expressão do livre progresso da personalidade. Defende-se, assim, o direito de expressão religiosa no ambiente de trabalho, o qual é corroborado pela liberdade religiosa prevista na legislação portuguesa e brasileira, que deve sempre ser observada e praticada com proporcionalidade e boa-fé. Abstract The employment relationship creates a very favorable area for the enlargement of conflicts based on the manifestation of religious phenomenon. The will to solve them sometimes slips on a maladjusted perception of the constitutional characterization of the fundamental right to religious freedom. The present thesis aims to look for accurate legal answers to problems related to the exercise of religious freedom during all the phases of the employment contract, according to the Brazilian and Portuguese legislation. The investigation for accurate legal answers is based on the concept that all workers have their own beliefs and religions. It is impossible to separate the religion/belief from the believer worker, once their affirmation into the labor environment is part of the expression of their own personality. Therefore is defensible for the workers to express their religious faith in the professional environment based on the right of religious freedom foresee in the Brazilian and Portuguese legislation, which must always be observed and practiced proportionally and with good-faith
