Ao longo do tempo, o Estado, sob diferentes formas e face a diferentes pressões externas e internas, foi integrando ou excluindo algumas das instâncias de resolução de conflitos que compõe o quadro da pluralidade jurídica. As diferentes lógicas políticas e jurídicas que fazem parte da história do país não foram sempre totalmente substituídas, coexistindo, em grande medida, na sociedade de hoje. Dividindo a história de Moçambique em três períodos – colonialismo, socialismo e neoliberalismo/democracria – analiso a evolução da relação entre as várias formas de Estado e os tribunais populares de base, as autoridades tradicionais e os tribunais comunitários, centrando-me não apenas nas configurações que o Estado pretendeu criar, mas também no modo como aquelas instâncias foram resistindo às imposições exteriores. Legal pluralism in Mozambique is extremely interesting and complex for the quantity and diversity of legal orders and dispute resolution forums that operate on the field, as well as for the complex interrelations between them. During the years, Mozambican state, under different models and facing diverse internal and external pressures, come to integrate or exclude some of the community instances of dispute resolution which constitute the landscape of Mozambican legal pluralism. The different models state had gone through since the colonial period had not always been erased for good, being to a great extent overlapped within the contemporary Mozambican society. In this paper I divide the history in three periods – colonialism, socialism and neoliberal democracy – and analyze the development of the relation between the state and local popular courts, community courts, traditional authorities and Dinamyzing Groups, focusing not only in the configurations the state intended to create but also in the way these instances come to resist or use the external impositions. |
