A tutela penal do idoso : a indagação sobre um novo (velho?) bem jurídico

Abstract

A indagação sobre um novo (velho?) bem jurídico pretende analisar a solução, por enquanto, plasmada no ordenamento jurídico-penal português, a fim de, revestindo-a de distintas orientações, concluir pela necessidade (ou não) de novas concretizações. Centrado na pessoa velha, o presente estudo pretende ser o palco onde convergem as ideias de vulnerabilidade e fragilidade – advindas da idade avançada –, vetores do (mais forte) apelo ao outro. Conscientes do papel do Direito Penal (de hoje), esquissamos (mais) um percurso jurídicoargumentativo, com vista à postulação de uma (verdadeira) Tutela Penal do Idoso. ABSTRACT The question about a new (old?) legal interest intends to analyze the solution, for a while, shaped in the portuguese legal and criminal law in order to, coating it in different directions, complete by the need (or not) of new achievements. Centred on the old person, the present study aims to be the stage where converge the ideas of vulnerability and fragility – arising from old age – vectors (of the strongest) appeal to another. Conscious of the role of criminal law (today), we intend (more) a legal and argumentative route for the postulation of a (real) Criminal Protection of the Elderly
