Reflexos da vítimodogmática no consentimento em direito penal

Abstract

Um dos poucos países que possuem uma detalhada codificação do consentimento do ofendido é Portugal, motivo pelo qual este serve de inspiração para outros ordenamentos jurídicos no mundo. Mesmo sendo referência para outros países, o instituto mostra-se ainda contraditório em certos aspectos, não sendo passivo de entendimentos, principalmente relacionados à sua natureza e seus limites. Por estes motivos, o trabalho a seguir apresentará, numa ótica voltada à vitimodogática penal, a importância do instituto nos dias atuais e suas ainda recentes discussões. ABSTRACT Defined by its detailed codification of the consent of the victim, Portugal is one of the few countries that serve as an inspiration to other legal systems of the world. Sprouting such widespread interest among other States, its study reveals itself as paramount, even if its debate sparks controversies (regarding its nature and limits) between those who discuss it. For the afore mentioned reasons, the following research will focus on the perspective of criminal victimdogmatic, the relevance of the institute in recent times and also its presentday discussions that remain so contemporary
