dc.descriptionThe TRIPS agreement is a complex piece of international trade law, and a major tool of globalization of IP rights. Several questions, however, are posed by the regulation provided therein. Does it mean the replacement of public taxes by private royalties? Why are moral rights of human creators (authors and inventors) simply ignored by the rules of world trade? Moreover, the exceptions to intellectual property rights (copyright and related rights, patents, trademarks, etc) are submitted to a general “three steps rule” of fairness which is primarily aimed to protect the demands of the world trade (more in concrete, the interests of world traders who hold IP rights). However, are national scientific, education, cultural and public health policies submitted to the demands of world trade related with intellectual property rights? What is the relation between EC law and WTO law, in special the TRIPS Agreement? These are the main questions addressed in this paper, which is aimed to provide a European perspective of the internationalization of intellectual property rights.por
