Abstract: Artigo elaborado durante um período de estudo na Roger Williams University (Rhode Island, USA) sobre a evolução do direito ambiental norte-americano nos últimos 30 anos. Analisa o contraste entre o modelo “command and control”, usado ao longo das décadas de 70 e 80 e a tentativa de “reinventar a regulação ambiental” dos anos 90, virada para a regulação de mercado, auto-regulação e maior partilha da informação entre reguladores, regulados e cidadãos. O Programa das Chuvas Ácidas do Clean Air Act é apresentado como a mais bem conseguida das tentativas de “reinvenção da regulação ambiental”, ao consagrar tendências de ambos os paradigmas da regulação ambiental testados ao longo dos últimos 30 anos, sendo provavelmente o modelo da regulação ambiental do futuro.
This text, prepared during a study period at Roger Williams University (Rhode Island, USA) pretends to summarize the north-American environmental law evolution of the past 30 years. It is about the contrast between “command and control”, which characterized environmental law in the 70ths and 80ths, and the intent to “reinvention of environmental regulation” of the 90’ths, with an approach guided to market and self regulation and to information sharing between regulators, industry and community. The Clean Air Act Acid Rain Program is presented as the most successful experience of American environmental law, which is probably the most outstanding tentative of reinventing environmental regulations, makes an abridgement of both tendencies and is probably the model of environmental regulation in the future.
L’article a été élaboré pendant un séjour d’étude à la Roger Williams University (Rhode Island, USA) et il considère l’évolution du droit de l’environnement nord-américain pendant les derniers 30 ans. Il analyse le contraste entre le modèle “command and control”, utilisé au long des décades 70 et 80 et l’essaye de “réinventer la réglementation environnementale” des années 90 tournée pour la réglementation du marché, l’auto réglementation et un partage augmenté de l’information entre ceux qui réglementent, ceux qui sont réglementés et les citoyens. Le “Programme des Pluies Acides” du Clean Air Act est présenté en tant que la tentative la plus réussie de “réinvention de la réglementation environnementale”, en consacrant des tendances des deux paradigmes de la réglementation environnementale testées tout au long des derniers 30 ans et en constituant probablement le modèle de réglementation environnementale du futur.
