A LIBERDADE DE CIRCULAÇÃO E A CIDADANIA EUROPEIA: UMA ANÁLISE PRÉ E PÓS BREXIT

Abstract

O âmbito de estudo do presente trabalho de dissertação volta-se, principalmente, em compreender o laço evolutivo entre a União Europeia, o direito de liberdade de circulação por ela implementado, o direito de cidadania que aos nacionais de seus Estados-membro atribuiu e o Reino Unido. Por este motivo, traz-se uma análise histórico-jurídica dos Tratados que constituíram primeiro a Comunidade Europeia e, sucessivamente, a União Europeia, com enfoque nos institutos supramencionados, analisando o envolvimento do Reino Unido nas etapas principais para o alcance do direito Europeu. neste aspecto – como hodiernamente conhecido. Mais, estuda-se a disposição do artigo 50º do Tratado da União Europeia, com a notificação e saída do Reino Unido da União Europeia e buscando entender com foi administrado o Acordo de Saída desse Estado-Membro da EU em relação aos cidadãos da União e aos nacionais do Reino Unido, até então também detentores de tal status. Para tanto, além da análise do Tratados da União Europeia em seu artigo 50º e do Tratado Sobre o Funcionamento da União Europeia no artigo 20º e subsequentes – sobre a cidadania da União e sua aplicabilidade – foi analisado como o Brexit impactou tais institutos e até que ponto a cidadania da União depende do vínculo entre o sujeito de direito e sua nacionalidade ser associada a de um Estado-Membro, dentro do período de transição e depois deste. Enfim, trazem-se julgamentos do Tribunal de Justiça da União que clarificaram algumas questões sobre o atual estado sobretudo dos britânicos, até então detentores de cidadania europeia e dos direitos dela oriundos.

The aim of the present dissertation is mainly focused on understanding the evolutionary bond between the European Union, the right of freedom of movement implemented by the UE itself, the right of citizenship associated to the nationals of its Member States and the United Kingdom. For this reason, it is necessary to bring an historical-legal analysis of the Treaties that first constituted the European Community and, successively, the European Union, focusing on the institutes mentioned above, analyzing the involvement of the United Kingdom in the main stages for the achievement of European law. Furthermore, it is studied the provision of article 50 of the Treaty on European Union, with the notification and withdrawal of the United Kingdom from the European Union and seeking to understand how the Withdrawal Agreement of that Member State from the EU was administered in relation to citizens of the Union and to UK nationals, who until then also held such status. To this end, in addition to the analysis of the European Union Treaties in Article 50º and the Treaty on the Functioning of the European Union in Article 20º and the subsequent ones – on Union citizenship and its applicability – it was analyzed how Brexit impacted such institutes and how much the citizenship of the Union depends on the link between the subject of law and its nationality being associated with that of a Member State, within the transition period and after it. Finally, judgments of the Court of Justice of the Union are presented in order to clarify some questions about the current state, especially of the British, until then holders of European citizenship and the rights arising from it.
