Teoria Geral e Princípio do Desenvolvimento Sustentável: Conciliando Desenvolvimento, Ambiente e Justiça

Abstract

O objetivo geral desta tese é o de estruturar uma teoria geral do desenvolvimento sustentável, identificando e sistematizando elementos já existentes, propondo alguns elementos novos e, principalmente, analisando a interação entre eles. Inicialmente, busca-se “assentar as bases” da teoria, preparando o seu solo através da análise de como se deu a construção histórico-jurídica do discurso do desenvolvimento sustentável, resgatando e compreendendo os fatos históricos e as produções jurídicas que embasaram o nascimento e a construção do respectivo conceito e suas discussões correlatas. Em seguida, objetiva-se “revisar as motivações” do desenvolvimento sustentável, isto é, oferecer uma sistematização e diagnóstico da crise ecológica e seus dois elementos principais, a insustentabilidade ambiental e a insustentabilidade socioeconômica, demonstrando com isso a situação de gravidade e urgência em que nos encontramos, que nos leva ao risco de um colapso. Após, já tendo as bases assentadas e as motivações revisadas, o trabalho se debruça em “erguer a teoria” propriamente, respondendo a uma série de perguntas sequenciais que representam o esqueleto da teoria e conduzem, ao final, à pergunta “o que é desenvolvimento sustentável”, cuja resposta significa a propositura de um conceito de desenvolvimento sustentável que agrega, sistematiza e resume, em poucas palavras, todo o conteúdo da respectiva teoria. E por fim, com a teoria já erguida, procura-se extrair o sentido nuclear do desenvolvimento sustentável, o seu propósito, o seu télos, a razão ética que o justifica, adentrando assim na análise das justiças e do princípio jurídico do desenvolvimento sustentável.

The general objective of this thesis is to structure a general theory of sustainable development, identifying and systematizing existing elements, proposing some new elements and, mainly, analyzing the interaction between them. Initially, it seeks to "lay the foundations" of the theory, preparing its soil through the analysis of how the historical-legal construction of the sustainable development discourse occurred, rescuing and understanding the historical facts and the legal productions that supported the birth and the construction of the respective concept and its related discussions. The next objective is to "revise the motivations" of sustainable development, that is, to offer a systematization and diagnosis of the ecological crisis and its two main elements, environmental unsustainability and socio-economic unsustainability, thus demonstrating the seriousness and urgency in that we find ourselves, which leads us to the risk of a collapse. Then, with the foundations laid down and the motivations reviewed, the work focuses on "raising theory" itself, responding to a series of sequential questions that represent the skeleton of theory and ultimately lead to the question "what is development sustainable", whose answer means the proposal of a concept of sustainable development that systematizes and summarizes the whole content of the respective theory. And finally, with the theory already raised, we try to extract the nuclear sense of sustainable development, its purpose, its telos, the ethical reason that justifies it, thus entering into the analysis of justice and the legal principle of sustainable development.
