El Sistema Europeo Común de Asilo: entre la protección de los derechos humanos y la integración europea

Abstract

En este artículo se parte de un análisis del Sistema Europeo Común de Asilo, en específico en el caso de España, para abordar la posición paradigmática del derecho de asilo como protector del derecho a la vida. Se analiza en las siguientes páginas cómo el asilo contribuye a integrar al sujeto solicitante de protección dentro de la estructura jurídico-legal y social del Estado que lo acoge, al tiempo que el Estado se integra en la Comunidad Internacional como ente respetuoso de los Derechos Humanos. A modo de conclusión, el asilo posibilita pensar una ciudadanía global particular, sin ciudadanía efectiva pero construida desde el imperativo de proteger la vida humana, independientemente del Estado de pertenencia. Desde esta perspectiva el análisis del asilo muestra un trasfondo teórico y sociopolítico que subraya la actualidad del asilo no sólo en términos cuantitativos sino también cualitativos.

This article begins with an analysis of the Common European Asylum System, specifically in the case of Spain, to address the paradigmatic position of the right to asylum as a protector of the right to life. It is analyzed in the following pages how asylum contributes to integrate the subject requesting protection within the juridical-legal and social structure of the host State, while the State is integrated into the International Community as an entity that respects Human Rights. In conclusion, asylum makes it possible to think of a particular global citizenship, without effective citizenship but built from the imperative of protecting human life, regardless of the State of belonging. From this perspective, the analysis of asylum shows a theoretical and socio-political background that underlines the current status of asylum not only in quantitative but also qualitative terms.
