A Evolução do Direito Público Agrícola sob a Influência da Economia Circular: os poderes públicos na defesa de uma agricultura circular

Abstract

O propósito desta dissertação vai ao encontro de ser um contributo na defesa da sustentabilidade, por parte de vários intervenientes, sejam particulares, singulares ou coletivos, seja a Administração Pública e as suas instituições ou organismos públicos, no setor agrícola, perfilhando de ações económica e ambientalmente mais sustentáveis e verdes.Conjugar sincronicamente Poderes Públicos, Agricultura e Economia Circular são a chave deste trabalho. Tem-se como proposição a análise da influência e a evolução da intervenção da Administração no setor agrícola, orientada por princípios de economia circular. Trata-se, portanto, de uma temática atual da agenda política nacional e comunitária face a uma questão global que se reconduz às alterações climáticas, no seio de uma crise ambiental. Pretende-se pois, contribuir para o cumprimento dos Objetivos do Desenvolvimento Sustentável definidos na Agenda 2030, propondo que o setor agrícola adapte as suas técnicas, numa cadeia de valor, segundo princípios de uma economia circular, de valorização e aproveitamento dos recursos, isto é, uma agricultura circular, tarefa a que o Estado não pode escusar-se por força das gerações futuras e da própria Constituição da República. .

The purpose of this study is to be a contribution to the defence of sustainability by various stakeholders, whether private, singular or collective, whether the Public Administration and its institutions or public bodies, in the agricultural sector, aiming at more sustainable and greener economic and environmental actions.Conjugating synchronically Public Powers, Agriculture and Circular Economy are the key of this work. The proposition is to analyse the influence and evolution of the Administration's intervention in the agricultural sector, guided by circular economy principles. It is, therefore, a current issue on the national and community political agenda in the face of a global issue that leads to climate change, within an environmental crisis. It is therefore intended to contribute to the achievement of the Sustainable Development Goals set out in the 2030 Agenda, proposing that the agricultural sector adapts its techniques, in a value chain, according to the principles of a circular economy, enhancement and use of resources, that is, a circular agriculture, a task that the State cannot escape by virtue of future generations and the Constitution of the Republic itself. .
