A REGULAÇÃO DO EXERCÍCIO DAS RESPONSABILIDADES PARENTAIS EM CASOS DE VIOLÊNCIA DOMÉSTICA - UMA ANÁLISE JURISPRUDENCIAL

Abstract

O fim da vida em comum de um casal que tenha filhos/as menores obriga a que, no que respeita a estes, seja regulado o exercício das responsabilidades parentais nos termos dos arts. 1905.º e 1906.º do Código Civil. No fundo, significa isto que, no momento da cessação da vida conjugal do casal, impera a necessidade de atuação no sentido de disciplinar o modo concreto como, a partir daquele momento, funcionará a intervenção de cada um dos progenitores na vida dos/as seus/suas filhos/as, tendo sempre presente que, tratando-se de processos que têm como objeto decisões respeitantes ao futuro das crianças, estes têm de ser orientados conforme aquilo que se entenda serem os interesses destas, não se podendo sobrepor a estes os direitos e ideologias dos progenitores.Nos casos em que a separação dos progenitores tenha na sua génese violência doméstica – e igualmente nos casos em que essa violência doméstica tenha começado fruto da separação – será fundamental ter um cuidado acrescido com o futuro que se venha a garantir às crianças que possam ter sido expostas a esse evento traumático. O objeto da presente dissertação será, então, compreender de que forma devem as responsabilidades parentais ser fixadas nos casos em que há episódios de violência doméstica no seio familiar, cientes, ainda assim, de que não há uma resposta uniforme pois que cada criança é uma criança e cada família é uma família. Para tanto, proponho-me analisar, numa primeira fase, o regime das responsabilidades parentais e, posteriormente, compreender de que forma é que a violência doméstica interfere com a fixação desse mesmo regime. Terminarei com uma análise jurisprudencial crítica sobre decisões tomadas no âmbito deste tema pois que, tratando-se de processos de jurisdição voluntária, acabam os Tribunais de Família e Menores por ter uma grande influência no que respeita à fixação de critérios no âmbito das responsabilidades parentais.

The end of life in common of a couple that has children requires that, with regard to these, the exercise of parental responsibilities is regulated under the terms of arts. 1905 and 1906 of the Civil Code.Basically, this means that, at the moment of the termination of the couple's marital life, there is a need to act in order to discipline the concrete way in which, from that moment, will work the intervention of each parents in children's life , always bearing in mind that, in the case of processes that have as their object decisions concerning the future of children, they must be guided according to what is understood to be their interests, and rights cannot be superimposed on these and parenting ideologies.In cases where there is domestic violence in the separation genesis - and also in cases where this domestic violence has started as a result of the separation - it will be essential to be extra careful about the future provided to children who may have been exposed to this traumatic event.This dissertation aims to understand how parental responsibilities should be fixed in cases where there are domestic violence episodes within the family, although we are aware that there is no consensual answer, since each child is a child and every family is a family in a single way.Therefore I propose to analyze, in a first moment, the regime of parental responsibilities and, later, to understand how domestic violence interferes with the establishment of that regime.I will end this dissertation with a critical jurisprudential analysis about the decisions taken in the scope of this theme. When we consider the cases of voluntary jurisdiction, the Family and Minors Courts end up having a great influence in which concerns to the establishment of criteria in the scope of parental responsibilities. .
