Abstract: O trabalho que se segue incide sobre o crime de violação, previsto no artigo 164.º do Código Penal Português. No âmbito da análise deste preceito legal, será feita uma breve referência sobre evolução da criminalidade sexual em Portugal, tendo em conta as alterações mais significativas e que contribuíram para a actual construção legal do crime de violação.Fundando-se o artigo 164.º no modelo do constrangimento, faremos um estudo sobre os aspectos positivos e negativos daquele, servindo-nos para isso, da análise de outras tipologias como o modelo do dissentimento e do constrangimento e a respectiva comparação com o actual modelo vigente em Portugal. Ademais, abordaremos a importância que a Convenção de Istambul teve no desenvolvimento da conceção de que o crime de violação é um crime praticado essencialmente sem o consentimento da vítima, o que despoletou, em vários países europeus, mudanças chave na construção daquele ilícito. Neste sentido, será feita referência à importante alteração efectuada pelo legislador alemão no âmbito dos crimes sexuais do StGB, na qual o nosso legislador se baseou para a mais recente modificação ao artigo 164.º do Código Penal, pela Lei n.º101/2019. Esta alteração será analisada na presente dissertação por forma a aferir sobre a sua verdadeira importância e adequação na criminalidade sexual portuguesa, apurando deste modo, se a actual construção do ilícito de violação tutela efectivamente a liberdade sexual das vítimas, cumprindo assim também as obrigações provenientes da Convenção de Istambul sobre esta matéria.
The following work focuses on the crime of rape, provided for in article 164 of the Portuguese Penal Code. Within the scope of the analysis of this legal precept, a brief reference will be made on the evolution of sexual crime in Portugal, taking into consideration the most significant changes that contributed to the current legal construction of the crime of rape. Basing article 164.º on the embarrassment model, we will carry out a study on its positive and negative aspects, using the analysis of other typologies, such as the dissent and embarrassment model and the respective comparison with the current model in Portugal. Moreover, we will address the importance that the Istanbul Convention had in the development of the concept that the crime of rape is a crime essentially committed without the victim's consent, what triggered, in several European countries, key changes in the construction of that tort. Therefore, it will be made reference to the important change conducted by the German legislator in the scope of StGB sexual crimes, on which our legislator based the most recent amendment to article 164.º of the Penal Code, through Law No. 101/2019. This amendment will be analyzed in this dissertation in order to assess its true importance and suitability in Portuguese sexual crime, ascertaining this way, if the current construction of the tort of rape effectively protects the sexual freedom of victims, thereby also fulfilling the obligations arising from the Istanbul Convention on this subject.
