O exercício das responsabilidades parentais e as condutas de alienação parental após dissolução familiar

Abstract

A presente dissertação tem como tema principal as condutas de alienação parental no âmbito da regulação do exercício das responsabilidades parentais, em que se observa um alto conflito entre os progenitores após a sua ruptura. Assim sendo, este estudo vem destacar: i) os comportamentos adotados por um pai ou mãe que visa a ferir e a afastar o outro da vida do filho; ii) os efeitos nocivos que este fenômeno social poderá causar no desenvolvimento e no bem-estar das crianças; e iii) as medidas judiciais aplicáveis para evitar ou cessar a sua ocorrência. Inicialmente, o trabalho aborda a evolução da família e das responsabilidades parentais, enfatizando a importância atribuída pela legislação, jurisprudência e doutrina ao convívio familiar do menor com ambos os pais e a participação desses nas decisões relativas à vida do filho, de forma a assegurar o superior interesse da criança. Desta forma, o estudo faz referência aos principais tópicos quanto ao exercício das responsabilidades parentais no contexto de dissolução familiar e de condutas alienantes, quais sejam, a determinação da residência da criança, o direito de visita do progenitor não residente e os incumprimentos e alterações da regulação do exercício destas responsabilidades.Diante dos casos de alienação parental observados nos acórdãos de tribunais portugueses citados neste trabalho, o presente estudo vem expor os instrumentos legais a serem utilizados em tais circunstâncias. Diferente da legislação brasileira, que prevê uma lei específica para o tema, o ordenamento jurídico português dispõe de mecanismos judiciais suficientes a serem utilizados, entre eles, o RGPTC. Este diploma contém as medidas aplicáveis em situações de incumprimento da regulação do exercício das responsabilidades parentais, além de prever, se for o caso, a sua alteração. Também dispõe sobre a audição técnica especializada, a mediação familiar, a jurisdição voluntária e a audição das crianças, bem como a possibilidade de serem adotadas medidas provisórias. Ademais, para os casos mais graves, entende-se também pela aplicação da LPCJP e do CP, em seu art. 249.º, n.º 1, al. c). Por fim, o trabalho analisa a postura a ser adotada pelas entidades envolvidas nesses processo, como juízes, equipes técnicas multidisciplinares, advogados e Ministério Público, a fim de prevenir e interromper as condutas alienantes.

The main scope of the present dissertation is Parental Alienation behaviors in the context of the regulation of parental responsibilities in which conflicts are observed after a rupture between the parents. Owing to that, the current study highlights: i) the behaviors adopted by one parent that aims to wound and remove the other parent from the minor’s life; ii) the harmful effects this social phenomenon can cause on the development and well-being of the minor; and iii) the applicable legal measures to prevent or cease its occurrence. Firstly, the dissertation addresses the evolution of family and parental responsibilities. The proposal here is to emphasize how legislation, jurisprudence and doctrine consider that, as long as it ensures the children’s best interests, the presence of both parents in the minor’s life and their participation in the decisions regarding their child are of great importance. Subsequently, the study makes reference to the main topics regarding the exercise of parental responsibilities in the context of family dissolution and parental alienating behaviors, including the determination of the child's residence, the visiting rights of the non-resident parent and the breaches and modifications of the regulation of exercise of these responsibilities. In accordance to the parental alienation cases observed in the Portuguese courts mentioned throughout this work, the present study discloses the legal instruments that can be used in these circumstances. Unlike Brazilian law, which has a specific legislation for this subject, the Portuguese legal system has judicial mechanisms that can be used in these situations, being the RGPTC one of them. This diploma provides the applicable procedures in situations of breach of the regulated parental responsibilities and also predicts alterations when necessary. It also provides for specialized technical hearing, family mediation, voluntary jurisdiction and the children's hearing, as well as the possibility of adopting provisional decisions. In addition, for critical situations, there is also the application of the LPCJP and the Penal Code, in its art. 249, 1, c. Finally, this work analyzes the conduct that should be adopted by the entities involved in this process, such as judges, multidisciplinary technical teams, lawyers and public prosecution, in order to prevent and stop parental alienating behaviors.
