Os impactos da intervenção do amicus curiae em disputas judiciais: ofensa (ou não) ao princípio da igualdade das partes

Abstract

O presente trabalho objetivou analisar a técnica processual do amicus curiae, considerando a sua crescente utilização pelos ordenamentos jurídicos que adotam o sistema Civil Law e a proximidade que esses têm com Portugal, como por exemplo o Brasil. O estudo da técnica é relevante no âmbito do Processo Civil, pois a interferência do amigo na corte poderá ter implicações diversas, uma delas é o possível desrespeito a princípios do Processo Civil. A importância do estudo da técnica processual para o ordenamento jurídico português foi revelada quando houve a tentativa de se inserir a figura no Código de Processo Civil, no ano de 2012 e porque, mesmo sem normatização, a técnica tem sido utilizada timidamente por tribunais portugueses. Neste contexto, o presente estudo objetivou contribuir para a discussão científico-jurídica da técnica processual, ao estudar se a interferência do amicus curiae ofende (ou não) o princípio da igualdade das partes, utilizando a metodologia de revisão bibliográfica e estudo qualitativo de decisões judiciais do Supremo Tribunal Federal brasileiro (STF) e Superior Tribunal de Justiça brasileiro (STJ).O estudo concluiu que poderá existir ofensa o princípio da igualdade quando não respeitados os requisitos para deferimento da intervenção do amicus curiae. Além disso, que o princípio da igualdade deverá ser analisado sob um prisma geral, existindo casos em que a formalidade da lei - seu aspecto positivista - não poderá ser totalmente afastado em prol da busca pela igualdade substancial.

This study aims to analyze the procedural technique of the amicus curiae, considering its growing use by legal systems that adopt the Civil Law system and the proximity they have with Portugal (e.g. Brazil). The study of technique is relevant in the context of Civil Procedure, as the friend's interference in the court may have several implications, such as the possible disrespect for the principles of Civil Procedure.The importance of studying procedural technique for the Portuguese legal system was revealed when there was an attempt to insert the figure in the Code of Civil Procedure in 2012, and because even without standardization, the technique has been used timidly by Portuguese courts.Considering the relevance for Civil Procedure and the growing interest in using the technique in Portugal, this study aims to contribute to the scientific-legal discussion of procedural technique by studying whether the interference of the amicus curiae does of doesn't offend the principle of equality of the parties, via bibliographic review and qualitative study of judicial decisions within the scope of the Brazil’s Federal Supreme Court and Superior Court of Justice. The study concluded that there may be an offense against the principle of equality, when the requirements for granting the intervention of the amicus curiae are not respected. Furthermore, the principle of equality should be analyzed from a general perspective, there are cases in which the law - its positivist aspect - cannot be totally removed, in favor of the search for substantial equality.
