O Novo Pacto para a Migração e o Asilo

Abstract

Migration has been an ongoing factor in human history, with a profound impact on European society, its economy and its culture. It`s one of the main societal challenges that the EU is currently facing, with many loopholes that have proved difficult to fill effectively and with the solidarity that should be characteristic of the EU and its Member States. Safeguarding fundamental rights, free movement and ensuring security itself require an effective migration policy.On 23 September 2020, the European Commission launched a new Pact for Migration and Asylum, consisting of a set of legislative proposals that promise to bring a "fresh start" to the management of Migration and Asylum. In the launch of this new Pact, the Commission even mentions that the current system no longer works, presenting this package of proposals to put in place a reliable and effective migration management system. This is a very pertinent and topical subject, which, despite still being discussed between the European Parliament and the Council, when put into practice will certainly have many implications for the EU and its Member States, as well as for those seeking asylum in the EU. I seek to expose the components of the new Pact proposed by the European Commission in order to subsequently make a critical analysis, consulting articles by various commentators and specialists on the subject, on the consequences that may come from it. Taking into account the scope of the subject and the difficulty that exists in making progress in this area, the analysis deals with what is proposed by the Commission, since it is not yet known what may come into practice and in what manner.

A migração tem sido um fator corrente da historia da humanidade, com um impacto profundo na sociedade europeia, na sua economia e na sua cultura. É um dos principais desafios societais que a UE enfrenta atualmente, com muitas lacunas ao nível das competências que se têm provado difíceis de preencher eficazmente e com a solidariedade que deve ser caraterística da UE e dos respetivos EM. A própria salvaguarda de direitos fundamentais, livre circulação e garantia de segurança exigem uma política de migração eficaz.No dia 23 de setembro de 2020, a Comissão Europeia lançou um novo Pacto para a Migração e o Asilo, constituído por um conjunto de propostas legislativas que prometem trazer um “novo começo” para a gestão da Migração e Asilo. No lançamento deste novo Pacto, a Comissão refere mesmo que o sistema atual já não funciona, apresentando este pacote de propostas para pôr em prática um sistema de gestão da migração confiável e eficaz. Trata-se de um tema bastante pertinente e atual, que apesar de ainda estar a ser discutido entre Parlamento Europeu e Conselho, entrando em prática terá certamente muitas implicações para a UE e respetivos EM, bem como para aqueles que procuram asilo na UE. Procuro expor as componentes do novo Pacto proposto pela Comissão Europeia para posteriormente fazer uma análise crítica, consultando artigos de vários comentadores e especialistas no assunto, às consequências que poderão vir do mesmo. Tendo em conta o âmbito do tema e a dificuldade que existe em progredir neste mesmo âmbito, a análise trata o que é proposta pela Comissão, visto que não se sabe ainda o que poderá entrar em prática e em que moldes.
