A Tradução Jurídica: Considerações Gerais e Análise do Mercado em Portugal

Abstract

Com o surgimento de um mercado de trocas comerciais globais que são realizadas em inúmeras línguas, surgiu, de forma orgânica, a necessidade de cruzar dois ramos distintos do saber: a Tradução e o Direito. Uma vez que a autonomização dos Estudos da Tradução apenas ocorreu na segunda metade do século xx, a Tradução Jurídica também regista um início tardio como disciplina de estudo, sobretudo em Portugal. É neste enquadramento que este trabalho surge, com o ensejo de analisar o desenvolvimento da Tradução Jurídica e da profissão de tradutor jurídico em Portugal.O presente projeto está dividido em três partes. A primeira, sobre a contextualização da Tradução Jurídica em Portugal, que versa sobre as especificidades deste ramo da Tradução, em especial, trata da indefinição da matéria de trabalho (o texto jurídico), aborda o perfil do profissional da área, e analisa a oferta formativa de Tradução Jurídica no país. Na segunda parte, o objeto de desenvolvimento é o regime de certificação de traduções em Portugal, com referência ao processo de legalização de documentos, e o funcionamento das traduções judiciais, ou seja, as traduções realizadas no âmbito de um processo judicial. Nesta matéria, destaca-se a análise da lei, em particular, da Diretiva 2010/64/UE relativa ao direito à interpretação e tradução em processo penal, e a crítica à sua transposição, que se entende incompleta no nosso país. Por fim, a terceira parte do projeto versa sobre a análise de um questionário realizado junto de profissionais de Direito sobre o funcionamento do mercado de Tradução Jurídica, abordando, entre outras, as questões das encomendas de tradução jurídica e da motivação para externalizar ou não esses serviços.

With the emergence of a market of global commercial exchanges that are conducted in several languages, the need has arisen to cross two distinct branches of knowledge: Translation and Law. Since Translation Studies only became independent in the second half of the 20th century, Legal Translation has also had a late start as a discipline, especially in Portugal. This paper is written in this context, with the aim of analysing the development of Legal Translation and the profession of Legal Translator in Portugal.This project is divided into three parts. The first one is about the contextualisation of Legal Translation in Portugal, mentioning the specificities of this branch of Translation, especially the lack of definition of the subject matter (the legal text), addressing the profile of the professional in the field, and analysing the education in Legal Translation offer in the country. In the second part, the subject of development is the system of certification of Translations in Portugal, with reference to the process of legalisation of documents, and the system of Court Translations, i.e., translations carried out in a judicial proceeding. Regarding this matter, it is highlighted the analysis of the legislation, in particular, the Directive 2010/64/EU on the right to interpretation and translation in criminal proceedings, and the criticism of its incomplete transposition in our country. Finally, the third part of the project focuses on the analysis of a questionnaire conducted among legal professionals on the functioning of the legal translation market, addressing, among other things, the issues of legal translation orders and the motivation for outsourcing or not these services.
