Pela transmissão do direito que suporta a parte/transmitente no processo (autor ou réu), caberá integrar a nova parte na posição em que aquele se encontrava. Destarte, ainda que não intervenha, o caso julgado reportar-se-lhe-á: o processo correu sem o adquirente mas respondeu ao direito que adquiriu; o transmitente garante a bilateralidade da instância continuando na causa enquanto substituto processual. A habilitação do adquirente do direito litigioso (artigo 356.º do Código de Processo Civil) e a garantia da extensão do caso julgado ao adquirente não-habilitado (n.º 3 do artigo 263.º) são os pilares pelos quais se edifica o problema da modificação subjectiva da instância. Cumprirá saber como construímos (normativamente, é claro, mas mais directamente, como o Tribunal e as partes devem construir) a(s) resposta(s) à vicissitude da transmissão. The following thesis intends to analyse the transfer of the litigated interest or liability during its legal case. The new party must be added to the position (as claimant or defendant) in which the previous party was. However, even if he isn’t added, the res judicata will report to him: the case proceeded without him but it decided the interest or liability that he got; the transferor guaranteed the bilaterality of the dispute by continuing the case as a procedural substitute. The substitution of the transferee (article 356.º of the Portuguese Code of Civil Procedure) and the res judicata regarding the non-added transferee (263.º/3) are the pillars by which the modification of the parties is built. We will have to know how the case responds (legally, certainly, but more directly, how the Court and the parties should respond) to the phenomenon. |
